106 the procurement of services for victims of family violence.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. The heading to Section 51.004, Human Resources
139 Code, is amended to read as follows:
1410 Sec. 51.004. CONTRACT ELIGIBILITY; PROCUREMENT;
1511 APPLICATION PROCESS [BIDS].
1612 SECTION 2. Section 51.004, Human Resources Code, is amended
1713 by amending Subsection (e), as amended by S.B. 219, Acts of the 84th
1814 Legislature, Regular Session, 2015, and by adding Subsections (f)
1915 and (g) to read as follows:
2016 (e) The commission shall use a noncompetitive procurement
2117 procedure to award a contract under Section 51.003(a) or (b) if the
2218 commission determines that there is no competition between eligible
2319 family violence centers for services or a service area. If the
2420 commission determines that there is competition between eligible
2521 family violence centers for services or a service area, the
2622 commission shall award a contract under Section 51.003(a) or (b)
2723 through an application process that considers the eligibility
2824 requirements and other factors provided in this section and
2925 allocates the money in accordance with this chapter and with
3026 consideration of the family violence services plan under Section
3127 51.0021 [a competitive procurement procedure].
3228 (f) The commission shall consult with a statewide family
3329 violence organization to develop the application process described
3430 in Subsection (e) but may not involve the organization in the
3531 contract selection or award process.
3632 (g) To the extent of any conflict between this section and
3733 any other law, including Chapter 2155, Government Code, this
3834 section controls.
3935 SECTION 3. Section 51.003(d), Human Resources Code, as
4036 amended by S.B. 219, Acts of the 84th Legislature, Regular Session,
4137 2015, is repealed.
4238 SECTION 4. The changes in law made by this Act apply only to
4339 a contract awarded on or after the effective date of this Act.
4440 SECTION 5. This Act takes effect immediately if it receives
4541 a vote of two-thirds of all the members elected to each house, as
4642 provided by Section 39, Article III, Texas Constitution. If this
4743 Act does not receive the vote necessary for immediate effect, this
4844 Act takes effect September 1, 2015.
