9	5		relating to an exemption from competitive bidding requirements for
10	6		the procurement of services for victims of family violence.
11	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	8		SECTION 1. The heading to Section 51.004, Human Resources
13	9		Code, is amended to read as follows:
14	10		Sec. 51.004. CONTRACT ELIGIBILITY; PROCUREMENT;
15	11		APPLICATION PROCESS [BIDS].
16	12		SECTION 2. Section 51.004, Human Resources Code, is amended
17	13		by amending Subsection (e), as amended by S.B. 219, Acts of the 84th
18	14		Legislature, Regular Session, 2015, and by adding Subsections (f)
19	15		and (g) to read as follows:
20	16		(e) The commission shall use a noncompetitive procurement
21	17		procedure to award a contract under Section 51.003(a) or (b) if the
22	18		commission determines that there is no competition between eligible
23	19		family violence centers for services or a service area. If the
24	20		commission determines that there is competition between eligible
25	21		family violence centers for services or a service area, the
26	22		commission shall award a contract under Section 51.003(a) or (b)
27	23		through an application process that considers the eligibility
28	24		requirements and other factors provided in this section and
29	25		allocates the money in accordance with this chapter and with
30	26		consideration of the family violence services plan under Section
31	27		51.0021 [a competitive procurement procedure].
32	28		(f) The commission shall consult with a statewide family
33	29		violence organization to develop the application process described
34	30		in Subsection (e) but may not involve the organization in the
35	31		contract selection or award process.
36	32		(g) To the extent of any conflict between this section and
37	33		any other law, including Chapter 2155, Government Code, this
38	34		section controls.
39	35		SECTION 3. Section 51.003(d), Human Resources Code, as
40	36		amended by S.B. 219, Acts of the 84th Legislature, Regular Session,
41	37		2015, is repealed.
42	38		SECTION 4. The changes in law made by this Act apply only to
43	39		a contract awarded on or after the effective date of this Act.
44	40		SECTION 5. This Act takes effect immediately if it receives
45	41		a vote of two-thirds of all the members elected to each house, as
46	42		provided by Section 39, Article III, Texas Constitution. If this
47	43		Act does not receive the vote necessary for immediate effect, this
48	44		Act takes effect September 1, 2015.
