8 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 7 | | SECTION 1. Section 264.408(d), Family Code, is amended to |
---|
10 | 8 | | read as follows: |

11 | 9 | | (d) A video recording of an interview of a child that is made |
---|
12 | 10 | | by [at] a center is the property of the prosecuting attorney |
---|
13 | 11 | | involved in the criminal prosecution of the case involving the |
---|
14 | 12 | | child. If no criminal prosecution occurs, the video recording is |
---|
15 | 13 | | the property of the attorney involved in representing the |
---|
16 | 14 | | department in a civil action alleging child abuse or neglect. If |
---|
17 | 15 | | the matter involving the child is not prosecuted, the video |
---|
18 | 16 | | recording is the property of the department if the matter is an |
---|
19 | 17 | | investigation by the department of abuse or neglect. If the |
---|
20 | 18 | | department is not investigating or has not investigated the matter, |
---|
21 | 19 | | the video recording is the property of the agency that referred the |
---|
22 | 20 | | matter to the center. [If the center employs a custodian of records |
---|
23 | 21 | | for video recordings of interviews of children, the center is |
---|
24 | 22 | | responsible for the custody of the video recording. A video |
---|
25 | 23 | | recording of an interview may be shared with other agencies under a |
---|
26 | 24 | | written agreement.] |
