66 AN ACT
77 relating to the eligibility of certain persons for the supplemental
88 nutrition assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.018 to read as follows:
1212 Sec. 33.018. INAPPLICABILITY OF CERTAIN FEDERAL LAW IN
1313 DETERMINING SNAP ELIGIBILITY. As authorized by 21 U.S.C. Section
1414 862a(d)(1)(B), 21 U.S.C. Section 862a(a)(2) applies in determining
1515 the eligibility of a person for the supplemental nutrition
1616 assistance program only for a two-year period beginning on the date
1717 the person is convicted of a felony offense that has as an element
1818 the possession, use, or distribution of a controlled substance, as
1919 defined in 21 U.S.C. Section 802.
2020 SECTION 2. The changes in law made by this Act apply only to
2121 a determination of eligibility of a person for supplemental
2222 nutrition assistance benefits made on or after the effective date
2323 of this Act. A determination of eligibility made before the
2424 effective date of this Act is governed by the law in effect on the
2525 date the determination was made, and the former law is continued in
2626 effect for that purpose.
2727 SECTION 3. If before implementing any provision of this Act
2828 a state agency determines that a waiver or authorization from a
2929 federal agency is necessary for implementation of that provision,
3030 the agency affected by the provision shall request the waiver or
3131 authorization and may delay implementing that provision until the
3232 waiver or authorization is granted.
3333 SECTION 4. This Act takes effect September 1, 2015.
