| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 22.06, Alcoholic Beverage Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 22.06. PROHIBITED INTERESTS. (a) Except as otherwise |
|---|
| 12 | 12 | | provided in Section 102.05 of this code and in Subsection (b) of |
|---|
| 13 | 13 | | this section, no person who holds a package store permit or owns an |
|---|
| 14 | 14 | | interest in a package store may have a direct or indirect interest |
|---|
| 15 | 15 | | in any of the following: |
|---|
| 16 | 16 | | (1) a manufacturer's, retail dealer's on-premise, or |
|---|
| 17 | 17 | | general, branch, or local distributor's license; |
|---|
| 18 | 18 | | (2) a wine and beer retailer's[, wine and beer |
|---|
| 19 | 19 | | retailer's off-premise,] or mixed beverage permit; or |
|---|
| 20 | 20 | | (3) the business of any of the permits or licenses |
|---|
| 21 | 21 | | listed in Subdivisions (1) and (2) of this subsection. |
|---|
| 22 | 22 | | (b) A package store permit and a retail dealer's off-premise |
|---|
| 23 | 23 | | license or a wine and beer retailer's off-premise permit may be |
|---|
| 24 | 24 | | issued to the same person. |
|---|
| 25 | 25 | | SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | (d) Subsections (a) and [,] (b)[, and (c)] shall not apply |
|---|
| 28 | 28 | | to a package store that qualifies for exemption under Section 11.50 |
|---|
| 29 | 29 | | or to a package store in a hotel that qualifies for exemption under |
|---|
| 30 | 30 | | Section 102.05. |
|---|
| 31 | 31 | | SECTION 3. Sections 22.04, 22.05, 22.14(c), and 22.16, |
|---|
| 32 | 32 | | Alcoholic Beverage Code, are repealed. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2015. |
