55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a task force to evaluate recreational
88 use of rivers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. RECREATIONAL RIVER USE TASK FORCE. (a) In this
1111 Act, "task force" means the Recreational River Use Task Force
1212 established under this section.
1313 (b) The Recreational River Use Task Force is established for
1414 the purposes of:
1515 (1) assessing the effects of recreational use of
1616 rivers on:
1717 (A) state and local economies;
1818 (B) environmental health; and
1919 (C) water quality; and
2020 (2) evaluating:
2121 (A) the safety of recreational users of rivers;
2222 (B) the quality of the recreational experience of
2323 river users; and
2424 (C) the public policy implications of increased
2525 recreational use of rivers.
2626 (c) The task force shall focus its efforts on areas of heavy
2727 recreational use of rivers.
2828 (d) The task force is composed of the following 11 members:
2929 (1) one representative of the Economic Development and
3030 Tourism Division of the governor's office, appointed by the
3131 governor;
3232 (2) one representative of the Texas Alcoholic Beverage
3333 Commission's Education and Prevention Division, appointed by the
3434 governor;
3535 (3) one representative of a river authority, appointed
3636 by the lieutenant governor;
3737 (4) one representative of an entity that is
3838 distinguished by its efforts in water resource protection,
3939 appointed by the lieutenant governor;
4040 (5) one elected official of a county in which
4141 recreational use of a river is high, appointed by the lieutenant
4242 governor;
4343 (6) one representative of a river recreation business,
4444 appointed by the speaker of the house of representatives;
4545 (7) one owner of residential riverfront property,
4646 appointed by the speaker of the house of representatives;
4747 (8) one elected official of a municipality in which
4848 recreational use of a river is high, appointed by the speaker of the
4949 house of representatives;
5050 (9) the presiding officer of the Texas Commission on
5151 Environmental Quality, or the officer's designee;
5252 (10) the presiding officer of the Parks and Wildlife
5353 Commission, or the officer's designee; and
5454 (11) the director of the Texas State University
5555 Meadows Center for Water and the Environment.
5656 (e) The members of the task force shall elect a presiding
5757 officer.
5858 (f) The Parks and Wildlife Department shall provide staff
5959 support to the task force.
6060 (g) The task force shall appoint a scientific advisory
6161 committee to serve as impartial scientific advisors for the task
6262 force. The director of the Texas State University Meadows Center
6363 for Water and the Environment shall serve as the presiding officer
6464 of the scientific advisory committee.
6565 (h) The task force shall hold public hearings to achieve the
6666 purposes described by Subsection (b).
6767 (i) A member of the task force or the scientific advisory
6868 committee is not entitled to receive compensation for service on
6969 the task force or committee but is entitled to reimbursement of the
7070 travel expenses incurred by the member while conducting the
7171 business of the task force or committee.
7272 (j) The task force may accept gifts and grants from any
7373 source to be used to carry out a function of the task force or the
7474 scientific advisory committee.
7575 SECTION 2. FINAL REPORT. Not later than November 1, 2016,
7676 the task force shall submit a final report to the governor, the
7777 lieutenant governor, the speaker of the house of representatives,
7878 the authors and sponsors of the Act creating the task force, and the
7979 members of the House Natural Resources Committee and the Senate
8080 Committee on Natural Resources and Economic Development. The report
8181 shall include a summary and analysis of:
8282 (1) hearings and studies conducted by the task force;
8383 (2) legislation proposed by the task force; and
8484 (3) other findings and recommendations made by the
8585 task force.
8686 SECTION 3. APPOINTMENTS. Not later than December 1, 2015,
8787 the governor, the lieutenant governor, and the speaker of the house
8888 of representatives shall make the appointments to the task force as
8989 described by Section 1(d) of this Act.
9090 SECTION 4. EXPIRATION. The task force is abolished and this
9191 Act expires August 31, 2017.
9292 SECTION 5. EFFECTIVE DATE. This Act takes effect
9393 immediately if it receives a vote of two-thirds of all the members
9494 elected to each house, as provided by Section 39, Article III, Texas
9595 Constitution. If this Act does not receive the vote necessary for
9696 immediate effect, this Act takes effect September 1, 2015.
