66 AN ACT
77 relating to health insurance identification cards issued by
88 qualified health plan issuers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 8, Insurance Code, is amended by adding
1111 Subtitle L to read as follows:
1212 SUBTITLE L. QUALIFIED HEALTH PLAN MANDATORY DISCLOSURES
1313 CHAPTER 1693. QUALIFIED HEALTH PLAN IDENTIFICATION CARDS
1414 Sec. 1693.001. DEFINITIONS. Except as provided by Section
1515 1693.003, in this chapter, "advance payments of the premium tax
1616 credit," "enrollee," "qualified health plan," and "qualified
1717 health plan issuer" have the meanings assigned by 45 C.F.R. Section
1818 155.20 as that section existed on January 1, 2015.
1919 Sec. 1693.002. REQUIRED INFORMATION. An identification
2020 card or other similar document issued by a qualified health plan
2121 issuer to an enrollee of a qualified health plan in this state must,
2222 in addition to any requirement under other law, including Sections
2323 843.209, 1301.162, and 1369.153, display on the card or document in
2424 a location of the issuer's choice:
2525 (1) the acronym "QHP"; or
2626 (2) if the enrollee receives advance payment of the
2727 premium tax credit, the acronym "QHP-S".
2828 Sec. 1693.003. COMMISSIONER DETERMINATIONS REGARDING
2929 FEDERAL REGULATIONS. (a) The commissioner shall monitor 45 C.F.R.
3030 Section 155.20 for amendments to the definitions listed in Section
3131 1693.001 and determine if it is in the best interest of the state to
3232 adopt an amended definition for purposes of this chapter. If the
3333 commissioner determines that it is in the best interest of the state
3434 to adopt the amended definition, the commissioner by rule shall
3535 adopt the amended definition.
3636 (b) In making the determination about an amendment, the
3737 commissioner shall consider, in addition to other factors
3838 affecting the public interest, the beneficial and adverse effects
3939 the amendment may have on:
4040 (1) individuals who are receiving medical care and
4141 health care services in this state; and
4242 (2) health care providers and physicians.
4343 Sec. 1693.004. REPORT TO LEGISLATURE. The commissioner
4444 shall prepare a report of a determination made under Section
4545 1693.003, including an explanation of the reasons for the
4646 determination, and file the report with the presiding officer of
4747 each house of the legislature not later than the 30th day after the
4848 date the determination is made.
4949 Sec. 1693.005. RULES. The commissioner may adopt rules as
5050 necessary to administer and enforce this chapter.
5151 SECTION 2. This Act takes effect September 1, 2015.
