64 AN ACT
75 relating to public meetings of joint airport boards.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 551.001(3), Government Code, is amended
108 to read as follows:
119 (3) "Governmental body" means:
1210 (A) a board, commission, department, committee,
1311 or agency within the executive or legislative branch of state
1412 government that is directed by one or more elected or appointed
1513 members;
1614 (B) a county commissioners court in the state;
1715 (C) a municipal governing body in the state;
1816 (D) a deliberative body that has rulemaking or
1917 quasi-judicial power and that is classified as a department,
2018 agency, or political subdivision of a county or municipality;
2119 (E) a school district board of trustees;
2220 (F) a county board of school trustees;
2321 (G) a county board of education;
2422 (H) the governing board of a special district
2523 created by law;
2624 (I) a local workforce development board created
2725 under Section 2308.253;
2826 (J) a nonprofit corporation that is eligible to
2927 receive funds under the federal community services block grant
3028 program and that is authorized by this state to serve a geographic
3129 area of the state; [and]
3230 (K) a nonprofit corporation organized under
3331 Chapter 67, Water Code, that provides a water supply or wastewater
3432 service, or both, and is exempt from ad valorem taxation under
3533 Section 11.30, Tax Code; and
3634 (L) a joint board created under Section 22.074,
3735 Transportation Code.
3836 SECTION 2. Subchapter C, Chapter 551, Government Code, is
3937 amended by adding Section 551.0501 to read as follows:
4038 Sec. 551.0501. JOINT BOARD: PLACE OF POSTING NOTICE.
4139 (a) In this section, "electronic bulletin board" means an
4240 electronic communication system that includes a perpetually
4341 illuminated screen on which the governmental body can post messages
4442 or notices viewable without manipulation by the public.
4543 (b) A joint board created under Section 22.074,
4644 Transportation Code, shall post notice of each meeting on a
4745 physical or electronic bulletin board at a place convenient to the
4846 public in the board's administrative offices.
4947 SECTION 3. The heading to Section 551.056, Government Code,
5048 is amended to read as follows:
5149 Sec. 551.056. ADDITIONAL POSTING REQUIREMENTS FOR CERTAIN
5250 MUNICIPALITIES, COUNTIES, SCHOOL DISTRICTS, JUNIOR COLLEGE
5351 DISTRICTS, [AND] DEVELOPMENT CORPORATIONS, AUTHORITIES, AND JOINT
5452 BOARDS.
5553 SECTION 4. Section 551.056(b), Government Code, is amended
5654 to read as follows:
5755 (b) In addition to the other place at which notice is
5856 required to be posted by this subchapter, the following
5957 governmental bodies and economic development corporations must
6058 also concurrently post notice of a meeting on the Internet website
6159 of the governmental body or economic development corporation:
6260 (1) a municipality;
6361 (2) a county;
6462 (3) a school district;
6563 (4) the governing body of a junior college or junior
6664 college district, including a college or district that has changed
6765 its name in accordance with Chapter 130, Education Code;
6866 (5) a development corporation organized under the
6967 Development Corporation Act (Subtitle C1, Title 12, Local
7068 Government Code); [and]
7169 (6) a regional mobility authority included within the
7270 meaning of an "authority" as defined by Section 370.003,
7371 Transportation Code; and
7472 (7) a joint board created under Section 22.074,
7573 Transportation Code.
7674 SECTION 5. The change in law made by this Act applies only
7775 to notice that is required to be posted on or after the effective
7876 date of this Act. Notice that is required to be posted prior to the
7977 effective date of this Act is governed by the law in effect at that
8078 time, and that law is continued in effect for that purpose.
8179 SECTION 6. This Act takes effect immediately if it receives
8280 a vote of two-thirds of all the members elected to each house, as
8381 provided by Section 39, Article III, Texas Constitution. If this
8482 Act does not receive the vote necessary for immediate effect, this
8583 Act takes effect September 1, 2015.
