66 AN ACT
77 relating to increasing the fee on conviction paid by a defendant for
88 a peace officer committing or releasing the defendant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 102.011(a), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (a) A defendant convicted of a felony or a misdemeanor shall
1313 pay the following fees for services performed in the case by a peace
1414 officer:
1515 (1) $5 for issuing a written notice to appear in court
1616 following the defendant's violation of a traffic law, municipal
1717 ordinance, or penal law of this state, or for making an arrest
1818 without a warrant;
1919 (2) $50 for executing or processing an issued arrest
2020 warrant, capias, or capias pro fine with the fee imposed for the
2121 services of:
2222 (A) the law enforcement agency that executed the
2323 arrest warrant or capias, if the agency requests of the court, not
2424 later than the 15th day after the date of the execution of the
2525 arrest warrant or capias, the imposition of the fee on conviction;
2626 or
2727 (B) the law enforcement agency that processed the
2828 arrest warrant or capias, if:
2929 (i) the arrest warrant or capias was not
3030 executed; or
3131 (ii) the executing law enforcement agency
3232 failed to request the fee within the period required by Paragraph
3333 (A) of this subdivision;
3434 (3) $5 for summoning a witness;
3535 (4) $35 for serving a writ not otherwise listed in this
3636 article;
3737 (5) $10 for taking and approving a bond and, if
3838 necessary, returning the bond to the courthouse;
3939 (6) $90 [$5] for commitment or release;
4040 (7) $5 for summoning a jury, if a jury is summoned; and
4141 (8) $8 for each day's attendance of a prisoner in a
4242 habeas corpus case if the prisoner has been remanded to custody or
4343 held to bail.
4444 SECTION 2. Section 102.021, Government Code, is amended to
4545 read as follows:
4646 Sec. 102.021. COURT COSTS ON CONVICTION: CODE OF CRIMINAL
4747 PROCEDURE. A person convicted of an offense shall pay the
4848 following under the Code of Criminal Procedure, in addition to all
4949 other costs:
5050 (1) court cost on conviction of any offense, other
5151 than a conviction of an offense relating to a pedestrian or the
5252 parking of a motor vehicle (Art. 102.0045, Code of Criminal
5353 Procedure) . . . $4;
5454 (2) a fee for services of prosecutor (Art. 102.008,
5555 Code of Criminal Procedure) . . . $25;
5656 (3) fees for services of peace officer:
5757 (A) issuing a written notice to appear in court
5858 for certain violations (Art. 102.011, Code of Criminal Procedure)
5959 . . . $5;
6060 (B) executing or processing an issued arrest

128128 SECTION 3. The change in law made by this Act applies only
129129 to a fee imposed for the commitment or release of a defendant
130130 convicted of an offense committed on or after the effective date of
131131 this Act. A fee imposed for the commitment or release of a
132132 defendant convicted of an offense committed before the effective
133133 date of this Act is governed by the law in effect on the date the
134134 offense was committed, and the former law is continued in effect for
135135 that purpose. For purposes of this section, an offense was
136136 committed before the effective date of this Act if any element of
137137 the offense occurred before that date.
138138 SECTION 4. This Act takes effect September 1, 2015.
