7 | 7 | | relating to classification of a liquid substance used to fill an |

8 | 8 | | electronic cigarette as a hazardous substance. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 501.002(a), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) A hazardous substance is: |
---|
13 | 13 | | (1) a substance or mixture of substances that is |
---|
14 | 14 | | toxic, corrosive, extremely flammable, flammable, combustible, an |
---|
15 | 15 | | irritant, or a strong sensitizer, or that generates pressure |
---|
16 | 16 | | through decomposition, heat, or other means, if the substance or |
---|
17 | 17 | | mixture of substances may cause substantial personal injury or |
---|
18 | 18 | | substantial illness during or as a proximate result of any |
---|
19 | 19 | | customary or reasonably foreseeable handling or use, including |
---|
20 | 20 | | reasonably foreseeable ingestion by children; |
---|
21 | 21 | | (2) a toy or other article, other than clothing, that |
---|
22 | 22 | | is intended for use by a child and that presents an electrical, |
---|
23 | 23 | | mechanical, or thermal hazard; [or] |
---|
24 | 24 | | (3) a radioactive substance designated as a hazardous |
---|
25 | 25 | | substance under Section 501.003; or |
---|
26 | 26 | | (4) a liquid substance used to fill or refill a device |
---|
27 | 27 | | that simulates smoking by using a mechanical heating element, |
---|
28 | 28 | | battery, or electronic circuit to deliver vapor that may include |
---|
29 | 29 | | nicotine to an individual inhaling from the device. |
---|
30 | 30 | | SECTION 2. This Act takes effect September 1, 2015. |
