99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the methods of delivery for required financial
1212 statement forms sent to certain municipal officeholders and
1313 candidates for municipal office.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 145.005(b), Local Government Code, is
1616 amended to read as follows:
1717 (b) The clerk or secretary shall deliver at least one copy
1818 of the form by mail, personal delivery, or e-mail or any other means
1919 of electronic transfer [two copies of the form] to each municipal
2020 officer or person who is appointed to a municipal office who is
2121 required to file under this chapter within the time prescribed by
2222 Section 572.030(c)(1), Government Code. The clerk or secretary
2323 shall deliver [mail] a copy of the form to each candidate for a
2424 municipal office filled by election who is required to file under
2525 this chapter not later than the 10th day before the deadline for
2626 filing the statement under Section 145.004(c).
2727 SECTION 2. Section 145.009(c), Local Government Code, is
2828 amended to read as follows:
2929 (c) It is a defense to prosecution under this section that
3030 the officer or candidate did not receive copies of the financial
3131 statement form required to be delivered [mailed] to the officer or
3232 candidate by this chapter.
3333 SECTION 3. Section 145.005(b), Local Government Code, as
3434 amended by this Act, applies only to a financial statement due on or
3535 after the effective date of this Act. A financial statement due
3636 before the effective date of this Act is governed by the law in
3737 effect on the date the financial statement was due, and the former
3838 law is continued in effect for that purpose.
3939 SECTION 4. Section 145.009(c), Local Government Code, as
4040 amended by this Act, applies only to an offense committed on or
4141 after the effective date of this Act. An offense committed before
4242 the effective date of this Act is governed by the law in effect on
4343 the date the offense was committed, and the former law is continued
4444 in effect for that purpose. For purposes of this section, an
4545 offense was committed before the effective date of this Act if any
4646 element of the offense occurred before that date.
4747 SECTION 5. This Act takes effect September 1, 2015.
