| 11 | 11 | | relating to the methods of delivery for required financial |
|---|
| 12 | 12 | | statement forms sent to certain municipal officeholders and |
|---|
| 13 | 13 | | candidates for municipal office. |

| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 145.005(b), Local Government Code, is |
|---|
| 16 | 16 | | amended to read as follows: |
|---|
| 17 | 17 | | (b) The clerk or secretary shall deliver at least one copy |
|---|
| 18 | 18 | | of the form by mail, personal delivery, or e-mail or any other means |
|---|
| 19 | 19 | | of electronic transfer [two copies of the form] to each municipal |
|---|
| 20 | 20 | | officer or person who is appointed to a municipal office who is |
|---|
| 21 | 21 | | required to file under this chapter within the time prescribed by |
|---|
| 22 | 22 | | Section 572.030(c)(1), Government Code. The clerk or secretary |
|---|
| 23 | 23 | | shall deliver [mail] a copy of the form to each candidate for a |
|---|
| 24 | 24 | | municipal office filled by election who is required to file under |
|---|
| 25 | 25 | | this chapter not later than the 10th day before the deadline for |
|---|
| 26 | 26 | | filing the statement under Section 145.004(c). |

| 27 | 27 | | SECTION 2. Section 145.009(c), Local Government Code, is |
|---|
| 28 | 28 | | amended to read as follows: |
|---|
| 29 | 29 | | (c) It is a defense to prosecution under this section that |
|---|
| 30 | 30 | | the officer or candidate did not receive copies of the financial |
|---|
| 31 | 31 | | statement form required to be delivered [mailed] to the officer or |
|---|
| 32 | 32 | | candidate by this chapter. |
|---|
| 33 | 33 | | SECTION 3. Section 145.005(b), Local Government Code, as |
|---|
| 34 | 34 | | amended by this Act, applies only to a financial statement due on or |
|---|
| 35 | 35 | | after the effective date of this Act. A financial statement due |
|---|
| 36 | 36 | | before the effective date of this Act is governed by the law in |
|---|
| 37 | 37 | | effect on the date the financial statement was due, and the former |
|---|
| 38 | 38 | | law is continued in effect for that purpose. |
|---|
| 39 | 39 | | SECTION 4. Section 145.009(c), Local Government Code, as |
|---|
| 40 | 40 | | amended by this Act, applies only to an offense committed on or |
|---|
| 41 | 41 | | after the effective date of this Act. An offense committed before |
|---|
| 42 | 42 | | the effective date of this Act is governed by the law in effect on |
|---|
| 43 | 43 | | the date the offense was committed, and the former law is continued |
|---|
| 44 | 44 | | in effect for that purpose. For purposes of this section, an |
|---|
| 45 | 45 | | offense was committed before the effective date of this Act if any |
|---|
| 46 | 46 | | element of the offense occurred before that date. |
|---|
| 47 | 47 | | SECTION 5. This Act takes effect September 1, 2015. |
