66 AN ACT
77 relating to the regulation of abortion providers and facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 245.010, Health and Safety Code, is
1010 amended by amending Subsection (a) and adding Subsection (c) to
1111 read as follows:
1212 (a) The rules must contain minimum standards to protect the
1313 health and safety of a patient of an abortion facility and must
1414 contain provisions requiring compliance with the requirements of
1515 Subchapter B, Chapter 171. [On and after September 1, 2014, the
1616 minimum standards for an abortion facility must be equivalent to
1717 the minimum standards adopted under Section 243.010 for ambulatory
1818 surgical centers.]
1919 (c) The standards may not be more stringent than Medicare
2020 certification standards, if any, for:
2121 (1) qualifications for professional and
2222 nonprofessional personnel;
2323 (2) supervision of professional and nonprofessional
2424 personnel;
2525 (3) medical treatment and medical services provided by
2626 an abortion facility and the coordination of treatment and
2727 services, including quality assurance;
2828 (4) sanitary and hygienic conditions within an
2929 abortion facility;
3030 (5) the equipment essential to the health and welfare
3131 of the patients;
3232 (6) clinical records kept by an abortion facility; and
3333 (7) management, ownership, and control of the
3434 facility.
3535 SECTION 2. Section 171.0031, Health and Safety Code, is
3636 repealed.
3737 SECTION 3. The changes in law made by this Act apply only to
3838 an abortion performed on or after the effective date of this Act.
3939 An abortion performed before the effective date of this Act is
4040 governed by the law in effect immediately before the effective date
4141 of this Act, and that law is continued in effect for that purpose.
4242 SECTION 4. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2015.
