| 7 | 7 | | relating to the regulation of abortion providers and facilities. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 245.010, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by amending Subsection (a) and adding Subsection (c) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) The rules must contain minimum standards to protect the |
|---|
| 13 | 13 | | health and safety of a patient of an abortion facility and must |
|---|
| 14 | 14 | | contain provisions requiring compliance with the requirements of |
|---|
| 15 | 15 | | Subchapter B, Chapter 171. [On and after September 1, 2014, the |
|---|
| 16 | 16 | | minimum standards for an abortion facility must be equivalent to |
|---|
| 17 | 17 | | the minimum standards adopted under Section 243.010 for ambulatory |
|---|
| 18 | 18 | | surgical centers.] |
|---|
| 19 | 19 | | (c) The standards may not be more stringent than Medicare |
|---|
| 20 | 20 | | certification standards, if any, for: |
|---|
| 21 | 21 | | (1) qualifications for professional and |
|---|
| 22 | 22 | | nonprofessional personnel; |
|---|
| 23 | 23 | | (2) supervision of professional and nonprofessional |
|---|
| 24 | 24 | | personnel; |
|---|
| 25 | 25 | | (3) medical treatment and medical services provided by |
|---|
| 26 | 26 | | an abortion facility and the coordination of treatment and |
|---|
| 27 | 27 | | services, including quality assurance; |
|---|
| 28 | 28 | | (4) sanitary and hygienic conditions within an |
|---|
| 29 | 29 | | abortion facility; |
|---|
| 30 | 30 | | (5) the equipment essential to the health and welfare |
|---|
| 31 | 31 | | of the patients; |
|---|
| 32 | 32 | | (6) clinical records kept by an abortion facility; and |
|---|
| 33 | 33 | | (7) management, ownership, and control of the |
|---|
| 34 | 34 | | facility. |
|---|
| 35 | 35 | | SECTION 2. Section 171.0031, Health and Safety Code, is |
|---|
| 36 | 36 | | repealed. |
|---|
| 37 | 37 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 38 | 38 | | an abortion performed on or after the effective date of this Act. |
|---|
| 39 | 39 | | An abortion performed before the effective date of this Act is |
|---|
| 40 | 40 | | governed by the law in effect immediately before the effective date |
|---|
| 41 | 41 | | of this Act, and that law is continued in effect for that purpose. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2015. |
