55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the purchase of certain insurance coverage and the
88 performance of related risk management services for certain
99 university systems and the component institutions of those systems.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 412.011, Labor Code, is amended by
1212 amending Subsections (c) and (e) and adding Subsection (j) to read
1313 as follows:
1414 (c) The office shall:
1515 (1) perform risk management for each state agency
1616 subject to this chapter, except to any extent limited by Subsection
1717 (j) [Chapter 412]; and
1818 (2) purchase insurance coverage under any line of
1919 insurance other than health or life insurance, including liability
2020 insurance authorized under Chapter 612, Government Code, for a
2121 state agency subject to Chapter 501, except for:
2222 (A) an institution subject to Section 501.022; or
2323 (B) a university system or component institution
2424 of a university system that has elected to purchase insurance
2525 coverage under Subsection (j)[, under any line of insurance other
2626 than health or life insurance, including liability insurance
2727 authorized under Chapter 612, Government Code].
2828 (e) A state agency subject to Chapter 501, except for an
2929 institution subject to Section 501.022 or a university system or
3030 component institution of the university system that has elected to
3131 purchase insurance coverage under Subsection (j), may not purchase
3232 property, casualty, or liability insurance coverage without the
3333 approval of the board.
3434 (j) The Texas State University System or a component
3535 institution of that system may purchase property, casualty, or
3636 liability insurance coverage without the approval of the board,
3737 provided that the system or institution, as applicable, notifies
3838 the office of the intended purchase in the manner and within the
3939 time prescribed under Section 412.051(b). The office may perform
4040 risk management services related to insurance coverage purchased
4141 without board approval under this subsection only on request of the
4242 purchasing university system or institution, as applicable.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2015.
