| 7 | 7 | | relating to the purchase of certain insurance coverage and the |
|---|
| 8 | 8 | | performance of related risk management services for certain |
|---|
| 9 | 9 | | university systems and the component institutions of those systems. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 412.011, Labor Code, is amended by |
|---|
| 12 | 12 | | amending Subsections (c) and (e) and adding Subsection (j) to read |
|---|
| 13 | 13 | | as follows: |
|---|
| 14 | 14 | | (c) The office shall: |
|---|
| 15 | 15 | | (1) perform risk management for each state agency |
|---|
| 16 | 16 | | subject to this chapter, except to any extent limited by Subsection |
|---|
| 17 | 17 | | (j) [Chapter 412]; and |
|---|
| 18 | 18 | | (2) purchase insurance coverage under any line of |
|---|
| 19 | 19 | | insurance other than health or life insurance, including liability |
|---|
| 20 | 20 | | insurance authorized under Chapter 612, Government Code, for a |
|---|
| 21 | 21 | | state agency subject to Chapter 501, except for: |
|---|
| 22 | 22 | | (A) an institution subject to Section 501.022; or |
|---|
| 23 | 23 | | (B) a university system or component institution |
|---|
| 24 | 24 | | of a university system that has elected to purchase insurance |
|---|
| 25 | 25 | | coverage under Subsection (j)[, under any line of insurance other |
|---|
| 26 | 26 | | than health or life insurance, including liability insurance |
|---|
| 27 | 27 | | authorized under Chapter 612, Government Code]. |
|---|
| 28 | 28 | | (e) A state agency subject to Chapter 501, except for an |
|---|
| 29 | 29 | | institution subject to Section 501.022 or a university system or |
|---|
| 30 | 30 | | component institution of the university system that has elected to |
|---|
| 31 | 31 | | purchase insurance coverage under Subsection (j), may not purchase |
|---|
| 32 | 32 | | property, casualty, or liability insurance coverage without the |
|---|
| 33 | 33 | | approval of the board. |
|---|
| 34 | 34 | | (j) The Texas State University System or a component |
|---|
| 35 | 35 | | institution of that system may purchase property, casualty, or |
|---|
| 36 | 36 | | liability insurance coverage without the approval of the board, |
|---|
| 37 | 37 | | provided that the system or institution, as applicable, notifies |
|---|
| 38 | 38 | | the office of the intended purchase in the manner and within the |
|---|
| 39 | 39 | | time prescribed under Section 412.051(b). The office may perform |
|---|
| 40 | 40 | | risk management services related to insurance coverage purchased |
|---|
| 41 | 41 | | without board approval under this subsection only on request of the |
|---|
| 42 | 42 | | purchasing university system or institution, as applicable. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2015. |
