55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibition of the use of credit scoring in
88 underwriting and rating certain personal lines of insurance
99 coverage.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 559.001, Insurance Code, is amended by
1212 amending Subdivision (10) and adding Subdivision (12) to read as
1313 follows:
1414 (10) "Insurer" means an insurer authorized to write
1515 property and casualty insurance in this state, including an
1616 insurance company, reciprocal or interinsurance exchange, mutual
1717 insurance company, capital stock company, county mutual insurance
1818 company, farm mutual insurance company, association, Lloyd's plan,
1919 or other entity writing personal insurance in this state. The term
2020 includes an affiliate, as described by this code, if that affiliate
2121 is authorized to write personal insurance in this state. The term
2222 does not include [a farm mutual insurance company or] an eligible
2323 surplus lines insurer under this code.
2424 (12) "Underwriting" means the selection of the risk
2525 that will be assumed by an insurer, including the decision whether
2626 to accept, deny, renew, nonrenew, reduce, or increase the amount of
2727 benefits payable under an insurance policy or the types of
2828 coverages available under an insurance policy.
2929 SECTION 2. Section 559.002, Insurance Code, is amended to
3030 read as follows:
3131 Sec. 559.002. APPLICABILITY OF CHAPTER. This chapter
3232 applies to an insurer that writes personal insurance coverage [and
3333 uses credit information or credit reports for the underwriting or
3434 rating of that coverage].
3535 SECTION 3. Section 559.004, Insurance Code, is amended to
3636 read as follows:
3737 Sec. 559.004. RULES. [(a)] The commissioner may adopt
3838 rules in the manner prescribed by Subchapter A, Chapter 36, as
3939 necessary to implement this chapter.
4040 [(b) The commissioner shall adopt rules that prescribe the
4141 allowable differences in rates charged by insurers due solely to
4242 the difference in credit scores.]
4343 SECTION 4. The heading to Subchapter B, Chapter 559,
4444 Insurance Code, is amended to read as follows:
4545 SUBCHAPTER B. PROHIBITED USE OF CREDIT SCORING AND
4646 CREDIT INFORMATION
4747 SECTION 5. Section 559.051, Insurance Code, is amended to
4848 read as follows:
4949 Sec. 559.051. PROHIBITION ON CERTAIN [PERMISSIBLE] USE OF
5050 CREDIT SCORING BY INSURERS. An insurer that writes a line of
5151 insurance subject to this chapter may not:
5252 (1) refuse to underwrite, cancel, or refuse to renew a
5353 risk based wholly or partly on the credit report or credit score of
5454 an insured or an applicant for insurance coverage; or
5555 (2) rate a risk based wholly or partly on the credit
5656 report or credit score of an insured or an applicant for insurance
5757 coverage in any manner, including:
5858 (A) the provision or removal of a discount;
5959 (B) assignment of an insured or an applicant for
6060 insurance coverage to a rating tier; or
6161 (C) placement of an insured or an applicant for
6262 insurance coverage with an affiliate [use credit scoring, except
6363 for factors that constitute unfair discrimination, to develop
6464 rates, rating classifications, or underwriting criteria regarding
6565 lines of insurance subject to this chapter].
6666 SECTION 6. The following laws are repealed:
6767 (1) Sections 559.001(1) and (2), Insurance Code;
6868 (2) Section 559.003, Insurance Code;
6969 (3) Sections 559.052, 559.053, 559.054, 559.055,
7070 559.056, and 559.057, Insurance Code; and
7171 (4) Subchapters C and D, Chapter 559, Insurance Code.
7272 SECTION 7. (a) Chapter 559, Insurance Code, as amended by
7373 this Act, applies only to a personal insurance policy that is
7474 delivered, issued for delivery, or renewed on or after January 1,
7575 2016.
7676 (b) A personal insurance policy delivered, issued for
7777 delivery, or renewed before January 1, 2016, is governed by the law
7878 as it existed immediately before January 1, 2016, and that law is
7979 continued in effect for that purpose.
8080 SECTION 8. This Act takes effect September 1, 2015.
