77 relating to authorizing the Post Oak Savannah Groundwater
88 Conservation District to use revenue from export fees to fund road
99 and water infrastructure projects.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 8865.003, Special
1212 District Local Laws Code, is amended to read as follows:
1313 Sec. 8865.003. FINDINGS OF PUBLIC PURPOSE [USE] AND
1414 BENEFIT.
1515 SECTION 2. Section 8865.003(a), Special District Local Laws
1616 Code, is amended to read as follows:
1717 (a) The district is created to:
1818 (1) serve a public use and benefit; and
1919 (2) design, construct, acquire, finance, improve,
2020 operate, or maintain water infrastructure and macadamized,
2121 graveled, or paved roads, or improvements, including storm
2222 drainage, in aid of those roads.
2323 SECTION 3. Subchapter C, Chapter 8865, Special District
2424 Local Laws Code, is amended by adding Section 8865.104 to read as
2525 follows:
2626 Sec. 8865.104. WATER INFRASTRUCTURE AND ROAD PROJECTS. (a)
2727 The district may use money collected under Section 8865.151 from
2828 export fees to design, acquire, construct, finance, improve,
2929 operate, and maintain water infrastructure and macadamized,
3030 graveled, or paved roads, or improvements, including storm
3131 drainage, in aid of those roads.
3232 (b) The district may convey to this state, a county, or a
3333 municipality for operation and maintenance, a road constructed
3434 under Subsection (a).
3535 (c) A road project must meet all applicable construction
3636 standards, zoning and subdivision requirements, and regulations of
3737 each municipality in whose corporate limits or extraterritorial
3838 jurisdiction the road project is located.
3939 (d) If a road project is not located in the corporate limits
4040 or extraterritorial jurisdiction of a municipality, the road
4141 project must meet all applicable construction standards,
4242 subdivision requirements, and regulations of each county in which
4343 the road project is located.
4444 (e) If the state will maintain and operate the road, the
4545 Texas Transportation Commission must approve the plans and
4646 specifications of the road project.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2015.
