| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 8865.003, Special |
|---|
| 12 | 12 | | District Local Laws Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 8865.003. FINDINGS OF PUBLIC PURPOSE [USE] AND |
|---|
| 14 | 14 | | BENEFIT. |
|---|
| 15 | 15 | | SECTION 2. Section 8865.003(a), Special District Local Laws |
|---|
| 16 | 16 | | Code, is amended to read as follows: |
|---|
| 17 | 17 | | (a) The district is created to: |
|---|
| 18 | 18 | | (1) serve a public use and benefit; and |
|---|
| 19 | 19 | | (2) design, construct, acquire, finance, improve, |
|---|
| 20 | 20 | | operate, or maintain water infrastructure and macadamized, |
|---|
| 21 | 21 | | graveled, or paved roads, or improvements, including storm |
|---|
| 22 | 22 | | drainage, in aid of those roads. |
|---|
| 23 | 23 | | SECTION 3. Subchapter C, Chapter 8865, Special District |
|---|
| 24 | 24 | | Local Laws Code, is amended by adding Section 8865.104 to read as |
|---|
| 25 | 25 | | follows: |
|---|
| 26 | 26 | | Sec. 8865.104. WATER INFRASTRUCTURE AND ROAD PROJECTS. (a) |
|---|
| 27 | 27 | | The district may use money collected under Section 8865.151 from |
|---|
| 28 | 28 | | export fees to design, acquire, construct, finance, improve, |
|---|
| 29 | 29 | | operate, and maintain water infrastructure and macadamized, |
|---|
| 30 | 30 | | graveled, or paved roads, or improvements, including storm |
|---|
| 31 | 31 | | drainage, in aid of those roads. |
|---|
| 32 | 32 | | (b) The district may convey to this state, a county, or a |
|---|
| 33 | 33 | | municipality for operation and maintenance, a road constructed |
|---|
| 34 | 34 | | under Subsection (a). |
|---|
| 35 | 35 | | (c) A road project must meet all applicable construction |
|---|
| 36 | 36 | | standards, zoning and subdivision requirements, and regulations of |
|---|
| 37 | 37 | | each municipality in whose corporate limits or extraterritorial |
|---|
| 38 | 38 | | jurisdiction the road project is located. |
|---|
| 39 | 39 | | (d) If a road project is not located in the corporate limits |
|---|
| 40 | 40 | | or extraterritorial jurisdiction of a municipality, the road |
|---|
| 41 | 41 | | project must meet all applicable construction standards, |
|---|
| 42 | 42 | | subdivision requirements, and regulations of each county in which |
|---|
| 43 | 43 | | the road project is located. |
|---|
| 44 | 44 | | (e) If the state will maintain and operate the road, the |
|---|
| 45 | 45 | | Texas Transportation Commission must approve the plans and |
|---|
| 46 | 46 | | specifications of the road project. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2015. |
