75 relating to the authority of an independent school district to

119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 11.168(a), Education Code, is amended to
1311 read as follows:
1412 (a) Except as provided by Subsection (b) or Section
1513 45.109(a-1), [or] (a-2), or (a-3), the board of trustees of a school
1614 district may not enter into an agreement authorizing the use of
1715 school district employees, property, or resources for the provision
1816 of materials or labor for the design, construction, or renovation
1917 of improvements to real property not owned or leased by the
2018 district.
2119 SECTION 2. Section 45.109, Education Code, is amended by
2220 adding Subsections (a-3) and (e) to read as follows:
2321 (a-3) An independent school district and a municipality,
2422 located wholly or partially in the boundaries of a county in which
2523 the district is located, may contract for the district to
2624 contribute district resources to pay a portion of the costs of the
2725 design, improvement, or construction of an instructional facility,
2826 stadium, or other athletic facility owned by, on the property of, or
2927 under the control of the municipality. A district may contribute
3028 district resources under this subsection only if the district and
3129 municipality enter into a written agreement authorizing the
3230 district to use that facility.
3331 (e) An agreement entered into before the construction of an
3432 instructional facility, stadium, or other athletic facility, as
3533 provided by Subsection (a-1), (a-2), or (a-3) does not violate
3634 Section 11.169.
3735 SECTION 3. This Act takes effect immediately if it receives
3836 a vote of two-thirds of all the members elected to each house, as
3937 provided by Section 39, Article III, Texas Constitution. If this
4038 Act does not receive the vote necessary for immediate effect, this
4139 Act takes effect September 1, 2015.
