75 relating to waivers of citation in certain family law suits.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 6.4035, Family Code, is amended by
108 amending Subsection (c) and adding Subsections (e) and (f) to read
119 as follows:
1210 (c) Notwithstanding Section 132.001, Civil Practice and
1311 Remedies Code, the waiver must be sworn before a notary public who
1412 is not an attorney in the suit. This subsection does not apply if
1513 the party executing the waiver is incarcerated.
1614 (e) The party executing the waiver may not sign the waiver
1715 using a digitized signature.
1816 (f) For purposes of this section, "digitized signature" has
1917 the meaning assigned by Section 101.0096.
2018 SECTION 2. Chapter 31, Family Code, is amended by adding
2119 Section 31.008 to read as follows:
2220 Sec. 31.008. WAIVER OF CITATION. (a) A party to a suit
2321 under this chapter may waive the issuance or service of citation
2422 after the suit is filed by filing with the clerk of the court in
2523 which the suit is filed the waiver of the party acknowledging
2624 receipt of a copy of the filed petition.
2725 (b) The party executing the waiver may not sign the waiver
2826 using a digitized signature.
2927 (c) The waiver must contain the mailing address of the party
3028 executing the waiver.
3129 (d) Notwithstanding Section 132.001, Civil Practice and
3230 Remedies Code, the waiver must be sworn before a notary public who
3331 is not an attorney in the suit. This subsection does not apply if
3432 the party executing the waiver is incarcerated.
3533 (e) The Texas Rules of Civil Procedure do not apply to a
3634 waiver executed under this section.
3735 (f) For purposes of this section, "digitized signature" has
3836 the meaning assigned by Section 101.0096.
3937 SECTION 3. Subchapter A, Chapter 45, Family Code, is
4038 amended by adding Section 45.0031 to read as follows:
4139 Sec. 45.0031. WAIVER OF CITATION. (a) A party to a suit
4240 under this subchapter may waive the issuance or service of citation
4341 after the suit is filed by filing with the clerk of the court in
4442 which the suit is filed the waiver of the party acknowledging
4543 receipt of a copy of the filed petition.
4644 (b) The party executing the waiver may not sign the waiver
4745 using a digitized signature.
4846 (c) The waiver must contain the mailing address of the party
4947 executing the waiver.
5048 (d) Notwithstanding Section 132.001, Civil Practice and
5149 Remedies Code, the waiver must be sworn before a notary public who
5250 is not an attorney in the suit. This subsection does not apply if
5351 the party executing the waiver is incarcerated.
5452 (e) The Texas Rules of Civil Procedure do not apply to a
5553 waiver executed under this section.
5654 (f) For purposes of this section, "digitized signature" has
5755 the meaning assigned by Section 101.0096.
5856 SECTION 4. Subchapter B, Chapter 45, Family Code, is
5957 amended by adding Section 45.107 to read as follows:
6058 Sec. 45.107. WAIVER OF CITATION. (a) A party to a suit
6159 under this subchapter may waive the issuance or service of citation
6260 after the suit is filed by filing with the clerk of the court in
6361 which the suit is filed the waiver of the party acknowledging
6462 receipt of a copy of the filed petition.
6563 (b) The party executing the waiver may not sign the waiver
6664 using a digitized signature.
6765 (c) The waiver must contain the mailing address of the party
6866 executing the waiver.
6967 (d) Notwithstanding Section 132.001, Civil Practice and
7068 Remedies Code, the waiver must be sworn before a notary public who
7169 is not an attorney in the suit. This subsection does not apply if
7270 the party executing the waiver is incarcerated.
7371 (e) The Texas Rules of Civil Procedure do not apply to a
7472 waiver executed under this section.
7573 (f) For purposes of this section, "digitized signature" has
7674 the meaning assigned by Section 101.0096.
7775 SECTION 5. Chapter 102, Family Code, is amended by adding
7876 Section 102.0091 to read as follows:
7977 Sec. 102.0091. WAIVER OF CITATION. (a) A party to a suit
8078 under this title may waive the issuance or service of citation after
8179 the suit is filed by filing with the clerk of the court in which the
8280 suit is filed the waiver of the party acknowledging receipt of a
8381 copy of the filed petition.
8482 (b) The party executing the waiver may not sign the waiver
8583 using a digitized signature.
8684 (c) The waiver must contain the mailing address of the party
8785 executing the waiver.
8886 (d) Notwithstanding Section 132.001, Civil Practice and
8987 Remedies Code, the waiver must be sworn before a notary public who
9088 is not an attorney in the suit. This subsection does not apply if
9189 the party executing the waiver is incarcerated.
9290 (e) The Texas Rules of Civil Procedure do not apply to a
9391 waiver executed under this section.
9492 SECTION 6. The changes in law made by this Act apply only to
9593 a suit that is commenced on or after the effective date of this Act.
9694 A suit that is commenced before that date is governed by the law as
9795 it existed on the date the suit was commenced, and the former law is
9896 continued in effect for that purpose.
9997 SECTION 7. This Act takes effect September 1, 2015.
