8 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 7 | | SECTION 1. Section 34.002(a), Family Code, is amended to |
---|
10 | 8 | | read as follows: |
---|
11 | 9 | | (a) A parent or both parents of a child may enter into an |
---|
12 | 10 | | authorization agreement with a relative of the child listed in |
---|
13 | 11 | | Section 34.001 to authorize the relative to perform the following |
---|
14 | 12 | | acts in regard to the child: |
---|
15 | 13 | | (1) to authorize medical, dental, psychological, or |
---|
16 | 14 | | surgical treatment and immunization of the child, including |
---|
17 | 15 | | executing any consents or authorizations for the release of |
---|
18 | 16 | | information as required by law relating to the treatment or |
---|
19 | 17 | | immunization; |
---|
20 | 18 | | (2) to obtain and maintain health insurance coverage |
---|
21 | 19 | | for the child and automobile insurance coverage for the child, if |
---|
22 | 20 | | appropriate; |
---|
23 | 21 | | (3) to enroll the child in a day-care program or |
---|
24 | 22 | | preschool or in a public or private elementary [primary] or |
---|
25 | 23 | | secondary school; |
---|
26 | 24 | | (4) to authorize the child to participate in |
---|
27 | 25 | | age-appropriate extracurricular, civic, social, or recreational |
---|
28 | 26 | | activities, including athletic activities; |
---|
29 | 27 | | (5) to authorize the child to obtain a learner's |
---|
30 | 28 | | permit, driver's license, or state-issued identification card; |
---|
31 | 29 | | (6) to authorize employment of the child; and |
---|
32 | 30 | | (7) to apply for and receive public benefits on behalf |
---|
33 | 31 | | of the child. |

34 | 32 | | SECTION 2. Section 101.028, Family Code, is amended to read |
---|
35 | 33 | | as follows: |
---|
36 | 34 | | Sec. 101.028. SCHOOL. "School" means an elementary [a |
---|
37 | 35 | | primary] or secondary school in which a child is enrolled or, if the |
---|
38 | 36 | | child is not enrolled in an elementary [a primary] or secondary |
---|
39 | 37 | | school, the public school district in which the child primarily |
---|
40 | 38 | | resides. For purposes of this section, a reference to elementary |
---|
41 | 39 | | school includes prekindergarten. |
---|
42 | 40 | | SECTION 3. Section 153.3101, Family Code, is amended to |
---|
43 | 41 | | read as follows: |
---|
44 | 42 | | Sec. 153.3101. REFERENCE TO "SCHOOL" IN STANDARD POSSESSION |
---|
45 | 43 | | ORDER. In a standard possession order, "school" means the |
---|
46 | 44 | | elementary [primary] or secondary school in which the child is |
---|
47 | 45 | | enrolled or, if the child is not enrolled in an elementary [a |
---|
48 | 46 | | primary] or secondary school, the public school district in which |
---|
49 | 47 | | the child primarily resides. |
---|
50 | 48 | | SECTION 4. Section 261.105(d), Family Code, is amended to |
---|
51 | 49 | | read as follows: |
---|
52 | 50 | | (d) If the department initiates an investigation and |
---|
53 | 51 | | determines that the abuse or neglect does not involve a person |
---|
54 | 52 | | responsible for the child's care, custody, or welfare, the |
---|
55 | 53 | | department shall refer the report to a law enforcement agency for |
---|
56 | 54 | | further investigation. If the department determines that the abuse |
---|
57 | 55 | | or neglect involves an employee of a public elementary [primary] or |
---|
58 | 56 | | secondary school, and that the child is a student at the school, the |
---|
59 | 57 | | department shall orally notify the superintendent of the school |
---|
60 | 58 | | district in which the employee is employed about the investigation. |
---|
61 | 59 | | SECTION 5. The changes in law made by this Act are |
---|
62 | 60 | | nonsubstantive and intended to conform references to "school" in |
---|
63 | 61 | | the Family Code to usage in other law. |
---|
64 | 62 | | SECTION 6. This Act takes effect September 1, 2015. |
