10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 9 | | SECTION 1. Section 30.022(h-1), Education Code, is amended |
---|
12 | 10 | | to read as follows: |
---|
13 | 11 | | (h-1) The Texas Facilities Commission shall provide all |
---|
14 | 12 | | facilities maintenance services for the physical facilities of the |
---|
15 | 13 | | school[, including facilities construction, cabling, facility |
---|
16 | 14 | | reconfiguration, and any other services] as provided by Section |
---|
17 | 15 | | 2165.007, Government Code [a memorandum of understanding between |
---|
18 | 16 | | the board and the Texas Facilities Commission]. |
---|
19 | 17 | | SECTION 2. Section 30.052(h-1), Education Code, is amended |
---|
20 | 18 | | to read as follows: |
---|
21 | 19 | | (h-1) The Texas Facilities Commission shall provide all |
---|
22 | 20 | | facilities maintenance services for the physical facilities of the |
---|
23 | 21 | | school[, including facilities construction, cabling, facility |
---|
24 | 22 | | reconfiguration, and any other services] as provided by Section |
---|
25 | 23 | | 2165.007, Government Code [a memorandum of understanding between |
---|
26 | 24 | | the board and the Texas Facilities Commission]. |
---|
27 | 25 | | SECTION 3. Section 2165.007(b), Government Code, is amended |
---|
28 | 26 | | to read as follows: |
---|
29 | 27 | | (b) Notwithstanding any other law, the commission shall |
---|
30 | 28 | | provide facilities management services in relation to all state |
---|
31 | 29 | | agency facilities in Travis County or a county adjacent to Travis |
---|
32 | 30 | | County. The commission's duty does not apply to: |
---|
33 | 31 | | (1) a facility owned or operated by an institution of |
---|
34 | 32 | | higher education; |
---|
35 | 33 | | (2) military facilities; |
---|
36 | 34 | | (3) facilities owned or operated by the Texas |
---|
37 | 35 | | Department of Criminal Justice; |
---|
38 | 36 | | (4) facilities owned or operated by the Texas Juvenile |
---|
39 | 37 | | Justice Department; |
---|
40 | 38 | | (5) facilities owned or operated by the Texas |
---|
41 | 39 | | Department of Transportation; |
---|
42 | 40 | | (6) the Capitol, including the Capitol Extension, the |
---|
43 | 41 | | General Land Office building, the Bob Bullock Texas State History |
---|
44 | 42 | | Museum, any museum located on the Capitol grounds, the Governor's |
---|
45 | 43 | | Mansion, and any property maintained by the Texas Historical |
---|
46 | 44 | | Commission under Sections 442.0072 and 442.0073; |
---|
47 | 45 | | (7) a facility determined by the commission to be |
---|
48 | 46 | | completely residential; |
---|
49 | 47 | | (8) a regional or field office of a state agency; |
---|
50 | 48 | | (9) a facility located within or on state park |
---|
51 | 49 | | property; |
---|
52 | 50 | | (10) the property known as the Finance Commission |
---|
53 | 51 | | Building described by deed recorded in Volume 5080, Page 1099, of |
---|
54 | 52 | | the Deed Records of Travis County, Texas; or |
---|
55 | 53 | | (11) the property known as the Credit Union Department |
---|
56 | 54 | | Building described by deed recorded in Volume 6126, Page 27, of the |
---|
57 | 55 | | Deed Records of Travis County, Texas[; |
---|
58 | 56 | | [(12) facilities owned or operated by the Texas School |
---|
59 | 57 | | for the Blind and Visually Impaired; or |
---|
60 | 58 | | [(13) facilities owned or operated by the Texas School |
---|
61 | 59 | | for the Deaf]. |
---|
62 | 60 | | SECTION 4. (a) Not later than September 1, 2015, the |
---|
63 | 61 | | following are transferred from the Texas School for the Blind and |
---|
64 | 62 | | Visually Impaired to the Texas Facilities Commission: |
---|
65 | 63 | | (1) all remaining powers, duties, functions, |
---|
66 | 64 | | programs, and activities of the Texas School for the Blind and |
---|
67 | 65 | | Visually Impaired relating to the maintenance of the school's |
---|
68 | 66 | | physical facilities; |
---|
69 | 67 | | (2) any obligations and contracts of the Texas School |
---|
70 | 68 | | for the Blind and Visually Impaired that are directly related to |
---|
71 | 69 | | implementing a power, duty, function, program, or activity |
---|
72 | 70 | | transferred under this subsection; and |
---|
73 | 71 | | (3) all property and records in the custody of the |
---|
74 | 72 | | Texas School for the Blind and Visually Impaired that are related to |
---|
75 | 73 | | a power, duty, function, program, or activity transferred under |
---|
76 | 74 | | this subsection and all funds appropriated by the legislature for |
---|
77 | 75 | | that power, duty, function, program, or activity. |
---|
78 | 76 | | (b) The Texas Facilities Commission and the Texas School for |
---|
79 | 77 | | the Blind and Visually Impaired shall enter into a memorandum of |
---|
80 | 78 | | understanding that establishes a plan for the identification and |
---|
81 | 79 | | transfer of the records, personnel, property, and unspent |
---|
82 | 80 | | appropriations of the Texas School for the Blind and Visually |
---|
83 | 81 | | Impaired that are used for purposes of the commission's powers and |
---|
84 | 82 | | duties directly related to the maintenance of the school's physical |
---|
85 | 83 | | facilities under Section 30.022, Education Code. |
---|
86 | 84 | | SECTION 5. (a) Not later than September 1, 2015, the |
---|
87 | 85 | | following are transferred from the Texas School for the Deaf to the |
---|
88 | 86 | | Texas Facilities Commission: |
---|
89 | 87 | | (1) all remaining powers, duties, functions, |
---|
90 | 88 | | programs, and activities of the Texas School for the Deaf relating |
---|
91 | 89 | | to the maintenance of the school's physical facilities; |
---|
92 | 90 | | (2) any obligations and contracts of the Texas School |
---|
93 | 91 | | for the Deaf that are directly related to implementing a power, |
---|
94 | 92 | | duty, function, program, or activity transferred under this |
---|
95 | 93 | | subsection; and |
---|
96 | 94 | | (3) all property and records in the custody of the |
---|
97 | 95 | | Texas School for the Deaf that are related to a power, duty, |
---|
98 | 96 | | function, program, or activity transferred under this subsection |
---|
99 | 97 | | and all funds appropriated by the legislature for that power, duty, |
---|
100 | 98 | | function, program, or activity. |
---|
101 | 99 | | (b) The Texas Facilities Commission and the Texas School for |
---|
102 | 100 | | the Deaf shall enter into a memorandum of understanding that |
---|
103 | 101 | | establishes a plan for the identification and transfer of the |
---|
104 | 102 | | records, personnel, property, and unspent appropriations of the |
---|
105 | 103 | | Texas School for the Deaf that are used for purposes of the |
---|
106 | 104 | | commission's powers and duties directly related to the maintenance |
---|
107 | 105 | | of the school's physical facilities under Section 30.052, Education |
---|
108 | 106 | | Code. |
---|
109 | 107 | | SECTION 6. This Act takes effect immediately if it receives |
---|
110 | 108 | | a vote of two-thirds of all the members elected to each house, as |
---|
111 | 109 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
112 | 110 | | Act does not receive the vote necessary for immediate effect, this |
---|
113 | 111 | | Act takes effect September 1, 2015. |
---|
