64 AN ACT
75 relating to management services for the physical facilities of the
86 Texas School for the Blind and Visually Impaired and the Texas
97 School for the Deaf.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 30.022(h-1), Education Code, is amended
1210 to read as follows:
1311 (h-1) The Texas Facilities Commission shall provide all
1412 facilities maintenance services for the physical facilities of the
1513 school[, including facilities construction, cabling, facility
1614 reconfiguration, and any other services] as provided by Section
1715 2165.007, Government Code [a memorandum of understanding between
1816 the board and the Texas Facilities Commission].
1917 SECTION 2. Section 30.052(h-1), Education Code, is amended
2018 to read as follows:
2119 (h-1) The Texas Facilities Commission shall provide all
2220 facilities maintenance services for the physical facilities of the
2321 school[, including facilities construction, cabling, facility
2422 reconfiguration, and any other services] as provided by Section
2523 2165.007, Government Code [a memorandum of understanding between
2624 the board and the Texas Facilities Commission].
2725 SECTION 3. Section 2165.007(b), Government Code, is amended
2826 to read as follows:
2927 (b) Notwithstanding any other law, the commission shall
3028 provide facilities management services in relation to all state
3129 agency facilities in Travis County or a county adjacent to Travis
3230 County. The commission's duty does not apply to:
3331 (1) a facility owned or operated by an institution of
3432 higher education;
3533 (2) military facilities;
3634 (3) facilities owned or operated by the Texas
3735 Department of Criminal Justice;
3836 (4) facilities owned or operated by the Texas Juvenile
3937 Justice Department;
4038 (5) facilities owned or operated by the Texas
4139 Department of Transportation;
4240 (6) the Capitol, including the Capitol Extension, the
4341 General Land Office building, the Bob Bullock Texas State History
4442 Museum, any museum located on the Capitol grounds, the Governor's
4543 Mansion, and any property maintained by the Texas Historical
4644 Commission under Sections 442.0072 and 442.0073;
4745 (7) a facility determined by the commission to be
4846 completely residential;
4947 (8) a regional or field office of a state agency;
5048 (9) a facility located within or on state park
5149 property;
5250 (10) the property known as the Finance Commission
5351 Building described by deed recorded in Volume 5080, Page 1099, of
5452 the Deed Records of Travis County, Texas; or
5553 (11) the property known as the Credit Union Department
5654 Building described by deed recorded in Volume 6126, Page 27, of the
5755 Deed Records of Travis County, Texas[;
5856 [(12) facilities owned or operated by the Texas School
5957 for the Blind and Visually Impaired; or
6058 [(13) facilities owned or operated by the Texas School
6159 for the Deaf].
6260 SECTION 4. (a) Not later than September 1, 2015, the
6361 following are transferred from the Texas School for the Blind and
6462 Visually Impaired to the Texas Facilities Commission:
6563 (1) all remaining powers, duties, functions,
6664 programs, and activities of the Texas School for the Blind and
6765 Visually Impaired relating to the maintenance of the school's
6866 physical facilities;
6967 (2) any obligations and contracts of the Texas School
7068 for the Blind and Visually Impaired that are directly related to
7169 implementing a power, duty, function, program, or activity
7270 transferred under this subsection; and
7371 (3) all property and records in the custody of the
7472 Texas School for the Blind and Visually Impaired that are related to
7573 a power, duty, function, program, or activity transferred under
7674 this subsection and all funds appropriated by the legislature for
7775 that power, duty, function, program, or activity.
7876 (b) The Texas Facilities Commission and the Texas School for
7977 the Blind and Visually Impaired shall enter into a memorandum of
8078 understanding that establishes a plan for the identification and
8179 transfer of the records, personnel, property, and unspent
8280 appropriations of the Texas School for the Blind and Visually
8381 Impaired that are used for purposes of the commission's powers and
8482 duties directly related to the maintenance of the school's physical
8583 facilities under Section 30.022, Education Code.
8684 SECTION 5. (a) Not later than September 1, 2015, the
8785 following are transferred from the Texas School for the Deaf to the
8886 Texas Facilities Commission:
8987 (1) all remaining powers, duties, functions,
9088 programs, and activities of the Texas School for the Deaf relating
9189 to the maintenance of the school's physical facilities;
9290 (2) any obligations and contracts of the Texas School
9391 for the Deaf that are directly related to implementing a power,
9492 duty, function, program, or activity transferred under this
9593 subsection; and
9694 (3) all property and records in the custody of the
9795 Texas School for the Deaf that are related to a power, duty,
9896 function, program, or activity transferred under this subsection
9997 and all funds appropriated by the legislature for that power, duty,
10098 function, program, or activity.
10199 (b) The Texas Facilities Commission and the Texas School for
102100 the Deaf shall enter into a memorandum of understanding that
103101 establishes a plan for the identification and transfer of the
104102 records, personnel, property, and unspent appropriations of the
105103 Texas School for the Deaf that are used for purposes of the
106104 commission's powers and duties directly related to the maintenance
107105 of the school's physical facilities under Section 30.052, Education
108106 Code.
109107 SECTION 6. This Act takes effect immediately if it receives
110108 a vote of two-thirds of all the members elected to each house, as
111109 provided by Section 39, Article III, Texas Constitution. If this
112110 Act does not receive the vote necessary for immediate effect, this
113111 Act takes effect September 1, 2015.
