75 relating to access to and fees associated with binding arbitration
86 of appraisal review board orders.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 41A.01, Tax Code, is amended to read as
119 follows:
1210 Sec. 41A.01. RIGHT OF APPEAL BY PROPERTY OWNER. As an
1311 alternative to filing an appeal under Section 42.01, a property
1412 owner is entitled to appeal through binding arbitration under this
1513 chapter an appraisal review board order determining a protest filed
1614 under Section 41.41(a)(1) or (2) concerning the appraised or market
1715 value of property if:
1816 (1) the property qualifies as the owner's residence
1917 homestead under Section 11.13; or
2018 (2) the appraised or market value, as applicable, of
2119 the property as determined by the order is $3 [$1] million or less.
2220 SECTION 2. Section 41A.03(a), Tax Code, is amended to read
2321 as follows:
2422 (a) To appeal an appraisal review board order under this
2523 chapter, a property owner must file with the appraisal district not
2624 later than the 45th day after the date the property owner receives
2725 notice of the order:
2826 (1) a completed request for binding arbitration under
2927 this chapter in the form prescribed by Section 41A.04; and
3028 (2) an arbitration deposit made payable to the
3129 comptroller in the amount of:
3230 (A) $450, if the property qualifies as the
3331 owner's residence homestead under Section 11.13 and the appraised
3432 or market value, as applicable, of the property is $500,000 or less,
3533 as determined by the order;
3634 (B) $500, if the property qualifies as the
3735 owner's residence homestead under Section 11.13 and the appraised
3836 or market value, as applicable, of the property is more than
3937 $500,000, as determined by the order;
4038 (C) $500, if the property does not qualify as the
4139 owner's residence homestead under Section 11.13 and the appraised
4240 or market value, as applicable, of the property is $1 million or
4341 less, as determined by the order;
4442 (D) $800, if the property does not qualify as the
4543 owner's residence homestead under Section 11.13 and the appraised
4644 or market value, as applicable, of the property is more than $1
4745 million but not more than $2 million, as determined by the order; or
4846 (E) $1,050, if the property does not qualify as
4947 the owner's residence homestead under Section 11.13 and the
5048 appraised or market value, as applicable, of the property is more
5149 than $2 million but not more than $3 million, as determined by the
5250 order [$500].
5351 SECTION 3. Section 41A.05(b), Tax Code, is amended to read
5452 as follows:
5553 (b) The comptroller may retain $50 [an amount equal to 10
5654 percent] of the deposit to cover the comptroller's administrative
5755 costs.
5856 SECTION 4. Section 41A.06(b), Tax Code, is amended to read
5957 as follows:
6058 (b) To initially qualify to serve as an arbitrator under
6159 this chapter, a person must:
6260 (1) meet the following requirements, as applicable:
6361 (A) be licensed as an attorney in this state; or
6462 (B) have:
6563 (i) completed at least 30 hours of training
6664 in arbitration and alternative dispute resolution procedures from a
6765 university, college, or legal or real estate trade association; and
6866 (ii) been licensed or certified
6967 continuously during the five years preceding the date the person
7068 agrees to serve as an arbitrator as:
7169 (a) a real estate broker or
7270 salesperson under Chapter 1101, Occupations Code;
7371 (b) a real estate appraiser under
7472 Chapter 1103, Occupations Code; or
7573 (c) a certified public accountant
7674 under Chapter 901, Occupations Code; and
7775 (2) agree to conduct an arbitration for a fee that is
7876 not more than:
7977 (A) $400, if the property qualifies as the
8078 owner's residence homestead under Section 11.13 and the appraised
8179 or market value, as applicable, of the property is $500,000 or less,
8280 as determined by the order;
8381 (B) $450, if the property qualifies as the
8482 owner's residence homestead under Section 11.13 and the appraised
8583 or market value, as applicable, of the property is more than
8684 $500,000, as determined by the order;
8785 (C) $450, if the property does not qualify as the
8886 owner's residence homestead under Section 11.13 and the appraised
8987 or market value, as applicable, of the property is $1 million or
9088 less, as determined by the order;
9189 (D) $750, if the property does not qualify as the
9290 owner's residence homestead under Section 11.13 and the appraised
9391 or market value, as applicable, of the property is more than $1
9492 million but not more than $2 million, as determined by the order; or
9593 (E) $1,000, if the property does not qualify as
9694 the owner's residence homestead under Section 11.13 and the
9795 appraised or market value, as applicable, of the property is more
9896 than $2 million but not more than $3 million, as determined by the
9997 order [90 percent of the amount of the arbitration deposit required
10098 by Section 41A.03].
10199 SECTION 5. The change in law made by this Act applies only
102100 to a request for binding arbitration under Chapter 41A, Tax Code,
103101 that is filed on or after the effective date of this Act. A request
104102 for binding arbitration under Chapter 41A, Tax Code, that is filed
105103 before the effective date of this Act is governed by the law in
106104 effect on the date the request is filed, and the former law is
107105 continued in effect for that purpose.
108106 SECTION 6. This Act takes effect on September 1, 2015.
