55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the adoption of a schedule of fees for the compensation
88 of court-appointed defense counsel in criminal cases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 26.05(b), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (b) All payments made under this article shall be paid in
1313 accordance with a schedule of fees adopted by formal action of the
1414 judges of the county courts, statutory county courts, and district
1515 courts trying criminal cases in each county. A [On adoption of a]
1616 schedule of fees adopted as provided by this subsection must be
1717 delivered to the commissioners court of the county not later than
1818 the 90th day before the first day of the county's next fiscal year
1919 and, if delivered to the commissioners court on or before that 90th
2020 day, takes effect on that first day of the next fiscal year.
2121 Otherwise, the schedule of fees takes effect on the first day of the
2222 next fiscal year that begins at least 90 days after the date of
2323 delivery[, a copy of the schedule shall be sent to the commissioners
2424 court of the county ].
2525 SECTION 2. The change in law made by this Act applies only
2626 to the adoption of a schedule of fees that will take effect on or
2727 after January 1, 2016.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2015.
