The bill would amend the Code of Criminal Procedure, regarding the arrest of a defendant on a capias pro fine. Under current law, an officer executing a capias pro fine can hold the defendant in jail until the following business day if he cannot be brought before the court immediately. The bill would add an option for the peace officer to take the defendant before another court that has concurrent jurisdiction with the court that issued the capias pro fine. The Office of Court Administration indicates bill provisions are not anticipated to have a significant fiscal implication in the court system. Local Government Impact No significant fiscal implication to units of local government is anticipated.
