84 AN ACT
95 relating to the courts authorized to hear certain matters relating
106 to a capias pro fine.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Article 43.05, Code of Criminal Procedure, is
139 amended by adding Subsection (c) to read as follows:
1410 (c) If the court that issued the capias pro fine is
1511 unavailable, the arresting officer may, in lieu of placing the
1612 defendant in jail, take the defendant to:
1713 (1) another court in the same county with jurisdiction
1814 over Class A and Class B misdemeanors or a county criminal law
1915 magistrate court in the same county, if the court that issued the
2016 capias pro fine was a county court or a statutory county court with
2117 Class A and Class B misdemeanor jurisdiction; or
2218 (2) another court in the same county with jurisdiction
2319 over felony cases or a county criminal law magistrate court in the
2420 same county, if the court that issued the capias pro fine was a
2521 district court with felony jurisdiction.
2622 SECTION 2. Article 45.045, Code of Criminal Procedure, is
2723 amended by adding Subsection (a-1) to read as follows:
2824 (a-1) If the court that issued the capias pro fine is
2925 unavailable, the arresting officer may, in lieu of placing the
3026 defendant in jail, take the defendant to:
3127 (1) a justice of the peace court or county criminal law
3228 magistrate court with jurisdiction over Class C misdemeanors that
3329 is located in the same county, if the court that issued the capias
3430 pro fine was a justice of the peace court; or
3531 (2) a municipal court that is located in the same
3632 municipality, if the court that issued the capias pro fine was a
3733 municipal court.
3834 SECTION 3. Article 45.046, Code of Criminal Procedure, is
3935 amended by adding Subsection (d) to read as follows:
4036 (d) For purposes of a hearing described by Subsection (a),
4137 if the court that issued the capias pro fine is unavailable, the
4238 following judicial officers may conduct the hearing:
4339 (1) a justice of the peace or county criminal law
4440 magistrate with jurisdiction over Class C misdemeanors who is
4541 located in the same county as the issuing court, if the issuing
4642 court was a justice of the peace court; or
4743 (2) a municipal court judge who is located in the same
4844 municipality as the issuing court, if the issuing court was a
4945 municipal court.
5046 SECTION 4. This Act takes effect September 1, 2015.
