55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to training requirements for certain child-care workers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.0421, Human Resources Code, is
1010 amended by amending Subsections (a) and (f) and adding Subsections
1111 (a-1) and (j) to read as follows:
1212 (a) The minimum training standards prescribed by the
1313 department under Section 42.042(p) for an employee, director, or
1414 operator of a day-care center, group day-care home, or registered
1515 family home must include:
1616 (1) 60 [24] hours of initial training [that must be
1717 completed not later than the 90th day after the employee's first day
1818 of employment] for an employee of a day-care center who has no
1919 previous training or less than two years of employment experience
2020 in a regulated child-care facility, subject to the following
2121 requirements:
2222 (A) the employee must complete the initial
2323 training not later than the first anniversary of the employee's
2424 first day of employment;
2525 (B) the employee must complete at least 36 hours
2626 of the initial training not later than the 90th day after the
2727 employee's first day of employment; and
2828 (C) the employee must complete at least 24 [,
2929 eight] hours of the initial training [which must be completed]
3030 before the employee is given responsibility for a group of
3131 children;
3232 (2) 24 hours of annual training for each employee of a
3333 day-care center or group day-care home who has completed the
3434 initial training required by Subdivision (1), excluding the
3535 director, which must include at least:
3636 (A) six hours of training in one or more of the
3737 following areas:
3838 (i) [(A)] child growth and development;
3939 (ii) [(B)] guidance and discipline; and
4040 (iii) [(C)] age-appropriate curriculum;
4141 and
4242 (B) six hours of training in
4343 [(D)] teacher-child interaction; and
4444 (3) 30 hours of annual training for each director of a
4545 day-care center or group day-care home, or operator of a registered
4646 family home, which must include at least six hours of training in
4747 one or more of the following areas:
4848 (A) child growth and development;
4949 (B) guidance and discipline;
5050 (C) age-appropriate curriculum; and
5151 (D) teacher-child interaction.
5252 (a-1) Thirty hours of the initial training required under
5353 Subsection (a)(1), and the 12 hours of annual training required
5454 under Subsections (a)(2)(A) and (B) must be provided by a person who
5555 meets at least one of the qualifications listed under Subsection
5656 (f)(1), (2), (3), or (4).
5757 (f) The training required by this section must be
5858 appropriately targeted and relevant to the age of the children who
5959 will receive care from the individual receiving training and must
6060 be provided by a person who:
6161 (1) is a training provider registered with the Texas
6262 Early Care and Education Career Development System's Texas Trainer
6363 Registry that is maintained by the Texas Head Start State
6464 Collaboration Office;
6565 (2) is an instructor at a public or private secondary
6666 school, an institution of higher education, as defined by Section
6767 61.003, Education Code, or a private college or university
6868 accredited by a recognized accrediting agency who teaches early
6969 childhood development or another relevant course, as determined by
7070 rules adopted by the commissioner of education and the commissioner
7171 of higher education;
7272 (3) is an employee of a state agency with relevant
7373 expertise;
7474 (4) is a physician, psychologist, licensed
7575 professional counselor, social worker, or registered nurse;
7676 (5) holds a generally recognized credential [or
7777 possesses documented knowledge] relevant to the training the person
7878 will provide;
7979 (6) is a registered family home care provider or
8080 director of a day-care center or group day-care home in good
8181 standing with the department, if applicable, and who:
8282 (A) has demonstrated core knowledge in child
8383 development and caregiving; and
8484 (B) is only providing training at the home or
8585 center in which the provider or director and the person receiving
8686 training are employed; or
8787 (7) has at least two years of experience working in
8888 child development, a child development program, early childhood
8989 education, a childhood education program, or a Head Start or Early
9090 Head Start program and:
9191 (A) has been awarded a Child Development
9292 Associate (CDA) credential; or
9393 (B) holds at least an associate's degree in child
9494 development, early childhood education, or a related field.
9595 (j) The training required by this section may be provided in
9696 person or online.
9797 SECTION 2. Section 42.0421(a), Human Resources Code, as
9898 amended by this Act, applies only to an employee who is initially
9999 employed by a day-care center on or after the effective date of this
100100 Act. An employee who is initially employed by a day-care center
101101 before that date is subject to the law in effect immediately before
102102 the effective date of this Act, and the former law is continued in
103103 effect for that purpose.
104104 SECTION 3. This Act takes effect September 1, 2015.
