| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Section 408.103(a), Labor Code, is amended to |
|---|
| 12 | 10 | | read as follows: |
|---|
| 13 | 11 | | (a) Subject to Sections 408.061 and 408.062, the amount of a |
|---|
| 14 | 12 | | temporary income benefit is equal to: |
|---|
| 15 | 13 | | (1) 70 percent of the amount computed by subtracting |
|---|
| 16 | 14 | | the employee's weekly earnings after the injury from the employee's |
|---|
| 17 | 15 | | average weekly wage; or |
|---|
| 18 | 16 | | (2) for the first 26 weeks, 75 percent of the amount |
|---|
| 19 | 17 | | computed by subtracting the employee's weekly earnings after the |
|---|
| 20 | 18 | | injury from the employee's average weekly wage if the employee |
|---|
| 21 | 19 | | earns less than $10 [$8.50] an hour. |
|---|
| 22 | 20 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 23 | 21 | | claim for temporary income benefits based on a compensable injury |
|---|
| 24 | 22 | | that occurs on or after the effective date of this Act. A claim |
|---|
| 25 | 23 | | based on a compensable injury that occurs before the effective date |
|---|
| 26 | 24 | | of this Act is governed by the law in effect on the date the |
|---|
| 27 | 25 | | compensable injury occurred, and the former law is continued in |
|---|
| 28 | 26 | | effect for that purpose. |
|---|
| 29 | 27 | | SECTION 3. This Act takes effect September 1, 2015. |
