94 A BILL TO BE ENTITLED
105 AN ACT
116 relating to the disclosure of certain public information by a
127 public school district.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Subchapter B, Chapter 552, Government Code, is
1510 amended by adding Section 552.030 to read as follows:
1611 Sec. 552.030. REQUESTS FOR INFORMATION MADE TO SCHOOL
1712 DISTRICTS. (a) The control files of a database used by a school
1813 district to record financial information, or an analogous component
1914 that records the physical structure of the district's database, are
2015 public information subject to disclosure under this chapter.
2116 (b) A school district shall cooperate with a requestor to
2217 provide information requested under this chapter in the most
2318 efficient and cost-effective manner practicable.
2419 (c) This section does not require the disclosure of
2520 information for which an employee declines public access under
2621 Section 552.024 or of information made confidential under Section
2722 552.135 or 552.147.
2823 SECTION 2. The change in law made by this Act applies only
2924 to a request for public information made on or after the effective
3025 date of this Act. A request for public information made before the
3126 effective date of this Act is governed by the law in effect on the
3227 date of the request, and that law is continued in effect for that
3328 purpose.
3429 SECTION 3. This Act takes effect immediately if it receives
3530 a vote of two-thirds of all the members elected to each house, as
3631 provided by Section 39, Article III, Texas Constitution. If this
3732 Act does not receive the vote necessary for immediate effect, this
3833 Act takes effect September 1, 2015.
