66 AN ACT
77 relating to the eligibility for supplemental nutrition assistance
88 benefits for certain persons who owe delinquent child support.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.030 to read as follows:
1212 Sec. 33.030. ELIGIBILITY RESTRICTION FOR DELINQUENT CHILD
1313 SUPPORT PAYMENTS. (a) In this section, "Title IV-D agency" has the
1414 meaning assigned by Section 101.033, Family Code.
1515 (b) As authorized by 7 U.S.C. Section 2015(n), a person may
1616 not receive supplemental nutrition assistance benefits as a member
1717 of any household during any month in which the person is delinquent
1818 in making a court-ordered child support payment.
1919 (c) The restriction in Subsection (b) does not apply if a
2020 court has allowed the person to delay payment or if the person is
2121 complying with a payment plan approved by a court or the Title IV-D
2222 agency.
2323 (d) The department and the Title IV-D agency shall jointly
2424 enforce this section.
2525 SECTION 2. If before implementing any provision of this Act
2626 a state agency determines that a waiver or authorization from a
2727 federal agency is necessary for implementation of that provision,
2828 the agency affected by the provision shall request the waiver or
2929 authorization and may delay implementing that provision until the
3030 waiver or authorization is granted.
3131 SECTION 3. This Act takes effect September 1, 2015.
