| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 228.201, Transportation Code, is amended | |
| 11 | 11 | by adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) In determining the number of nontolled lanes required to | |
| 13 | 13 | comply with Subsection (a)(3), the department may consider only a | |
| 14 | 14 | general-purpose lane that is part of the highway and may not include | |
| 15 | 15 | a lane of a frontage road. | |
| 16 | 16 | SECTION 2. Section 228.201(c), Transportation Code, as | |
| 17 | 17 | added by this Act, applies only to a highway reconstruction in | |
| 18 | 18 | accordance with Section 228.201(a)(3), Transportation Code, that | |
| 19 | 19 | is begun on or after the effective date of this Act. A | |
| 20 | 20 | reconstruction begun before the effective date of this Act is | |
| 21 | 21 | governed by the law in effect when the reconstruction began, and the | |
| 22 | 22 | former law is continued in effect for that purpose. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2015. |
