66 AN ACT
77 relating to the establishment of a task force to promote uniformity
88 in the collection and reporting of information relating to family
99 violence, sexual assault, stalking, and human trafficking.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 72, Government Code, is amended by
1212 adding Subchapter F to read as follows:
1313 SUBCHAPTER F. TASK FORCE TO PROMOTE UNIFORMITY IN COLLECTION AND
1414 REPORTING OF INFORMATION ON FAMILY VIOLENCE, SEXUAL ASSAULT,
1515 STALKING, AND HUMAN TRAFFICKING
1616 Sec. 72.101. DEFINITIONS. In this subchapter:
1717 (1) "Family violence" has the meaning assigned by
1818 Section 71.004, Family Code.
1919 (2) "Task force" means the task force established
2020 under this subchapter to promote uniformity in the collection and
2121 reporting of information relating to family violence, sexual
2222 assault, stalking, and human trafficking.
2323 Sec. 72.102. TASK FORCE MEMBERSHIP. (a) The task force
2424 consists of:
2525 (1) one member from the office, appointed by the
2626 director;
2727 (2) 15 members appointed by the presiding officer of
2828 the task force as follows:
2929 (A) one member from the bureau of identification
3030 and records of the Department of Public Safety;
3131 (B) one member from a statewide family violence
3232 advocacy organization;
3333 (C) one member from a statewide sexual assault
3434 advocacy organization;
3535 (D) one member who is a prosecuting attorney with
3636 experience in obtaining protective orders in cases involving family
3737 violence, sexual assault, stalking, or human trafficking;
3838 (E) one member who is a magistrate with
3939 experience in issuing orders for emergency protection under Article
4040 17.292, Code of Criminal Procedure;
4141 (F) one member who is a judge or an associate
4242 judge with experience in issuing protective orders in cases
4343 involving family violence, sexual assault, stalking, or human
4444 trafficking;
4545 (G) one member from The University of Texas
4646 School of Law Domestic Violence Clinic;
4747 (H) one member who is from an organization that
4848 receives federal funding under the legal assistance for victims
4949 grant program and who has expertise in issues related to family
5050 violence, sexual assault, or stalking;
5151 (I) two members from a law enforcement agency,
5252 including one member who is a constable;
5353 (J) one member from the Texas Center for the
5454 Judiciary;
5555 (K) one member from the Texas Municipal Courts
5656 Education Center;
5757 (L) one member from the Texas Justice Court
5858 Training Center;
5959 (M) one member from the County and District
6060 Clerks' Association of Texas; and
6161 (N) one member from the child support division of
6262 the office of the attorney general; and
6363 (3) any other member whom the presiding officer
6464 determines to be appropriate and who consents to serve on the task
6565 force.
6666 (b) The presiding officer of the task force is the member
6767 who represents the office.
6868 (c) Appointed members of the task force serve at the will of
6969 the appointing authority. A vacancy on the task force must be
7070 filled in the same manner as the original appointment.
7171 Sec. 72.103. MEETINGS; COMPENSATION. (a) The task force
7272 shall meet at the call of the presiding officer.
7373 (b) Members of the task force serve without compensation or
7474 reimbursement for expenses.
7575 Sec. 72.104. DUTIES. (a) The task force shall:
7676 (1) solicit and receive reports and testimony from
7777 individuals, state and local agencies, community-based
7878 organizations, and other public and private organizations,
7979 including:
8080 (A) survivors of family violence, sexual
8181 assault, stalking, or human trafficking;
8282 (B) law enforcement officials whose duties
8383 include submitting information to the Texas Crime Information
8484 Center;
8585 (C) individuals with technical expertise in and
8686 familiarity with the programming and maintenance of the database
8787 maintained by the Texas Crime Information Center;
8888 (D) individuals with technical expertise in and
8989 familiarity with the office's database on family violence; and
9090 (E) individuals with expertise in issues related
9191 to family violence, sexual assault, stalking, or human trafficking;
9292 and
9393 (2) develop policy recommendations and best practices
9494 guidelines for the uniform collection and reporting of information
9595 relating to family violence, sexual assault, stalking, and human
9696 trafficking.
9797 (b) In developing policy recommendations and best practices
9898 guidelines under Subsection (a)(2), the task force shall examine:
9999 (1) the findings and recommendations of the "Best
100100 Practices for Lawyers Representing Survivors of Domestic Violence,
101101 Sexual Assault, Stalking, and Trafficking in the State of Texas"
102102 report commissioned by the State Bar of Texas Legal Services
103103 Support Division's Family Law Task Force;
104104 (2) best practices regarding uniform data collection
105105 and reporting; and
106106 (3) any other studies and reports that the task force
107107 considers relevant.
108108 Sec. 72.105. REPORT. Not later than September 1, 2016, the
109109 task force shall prepare and submit to the governor, the lieutenant
110110 governor, the speaker of the house of representatives, and the
111111 appropriate standing committees of the legislature a report that
112112 includes:
113113 (1) a description of the activities of the task force;
114114 (2) the findings and recommendations of the task
115115 force, including the policy recommendations and best practices
116116 guidelines developed by the task force under Section 72.104(a)(2);
117117 and
118118 (3) any other matter that the task force considers
119119 appropriate.
120120 Sec. 72.106. ADMINISTRATIVE SUPPORT. The office shall
121121 provide reasonably necessary administrative and technical support
122122 for the activities of the task force.
123123 Sec. 72.107. ASSISTANCE WITH RECOMMENDATIONS. The office
124124 shall seek the assistance of the task force before the office makes
125125 any recommendation as a result of the work done by the task force.
126126 Sec. 72.108. EXPIRATION DATE. The task force is abolished
127127 and this subchapter expires on September 1, 2017.
128128 SECTION 2. As soon as practicable after the effective date
129129 of this Act, the appropriate persons shall appoint the members of
130130 the task force created by Subchapter F, Chapter 72, Government
131131 Code, as added by this Act.
132132 SECTION 3. This Act takes effect immediately if it receives
133133 a vote of two-thirds of all the members elected to each house, as
134134 provided by Section 39, Article III, Texas Constitution. If this
135135 Act does not receive the vote necessary for immediate effect, this
136136 Act takes effect September 1, 2015.
