| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 38, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 38.1021 to read as follows: |
|---|
| 13 | 13 | | Sec. 38.1021. WELLNESS PLANS. (a) A school district shall |
|---|
| 14 | 14 | | develop an individual wellness plan for each student with physical |
|---|
| 15 | 15 | | fitness results on the assessment instrument administered under |
|---|
| 16 | 16 | | this subchapter that are below the standards identified in |
|---|
| 17 | 17 | | accordance with Section 38.102(b)(2). |
|---|
| 18 | 18 | | (b) A wellness plan required by this section must prescribe |
|---|
| 19 | 19 | | specific actions, including actions relating to dietary choices and |
|---|
| 20 | 20 | | physical activity levels, that should be taken by the student to |
|---|
| 21 | 21 | | improve the student's health. |
|---|
| 22 | 22 | | (c) A school district shall provide a copy of the wellness |
|---|
| 23 | 23 | | plan developed under this section to the student's parent not later |
|---|
| 24 | 24 | | than the 30th day after the date the district receives the student's |
|---|
| 25 | 25 | | physical fitness results. If the student is enrolled at or above |
|---|
| 26 | 26 | | the seventh grade level, the district shall also provide a copy of |
|---|
| 27 | 27 | | the student's wellness plan directly to the student. |
|---|
| 28 | 28 | | SECTION 2. Section 38.103, Education Code, is amended by |
|---|
| 29 | 29 | | adding Subsection (a-1) to read as follows: |
|---|
| 30 | 30 | | (a-1) A school district shall provide a parent with a copy |
|---|
| 31 | 31 | | of the results of the physical assessment of the parent's child if |
|---|
| 32 | 32 | | the results are below the standards identified in accordance with |
|---|
| 33 | 33 | | Section 38.102(b)(2). |
|---|
| 34 | 34 | | SECTION 3. This Act applies beginning with the 2015-2016 |
|---|
| 35 | 35 | | school year. |
|---|
| 36 | 36 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2015. |
