66 AN ACT
77 relating to parental notification of physical fitness assessment
88 results and development of wellness plans for certain public school
99 students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 38, Education Code, is
1212 amended by adding Section 38.1021 to read as follows:
1313 Sec. 38.1021. WELLNESS PLANS. (a) A school district shall
1414 develop an individual wellness plan for each student with physical
1515 fitness results on the assessment instrument administered under
1616 this subchapter that are below the standards identified in
1717 accordance with Section 38.102(b)(2).
1818 (b) A wellness plan required by this section must prescribe
1919 specific actions, including actions relating to dietary choices and
2020 physical activity levels, that should be taken by the student to
2121 improve the student's health.
2222 (c) A school district shall provide a copy of the wellness
2323 plan developed under this section to the student's parent not later
2424 than the 30th day after the date the district receives the student's
2525 physical fitness results. If the student is enrolled at or above
2626 the seventh grade level, the district shall also provide a copy of
2727 the student's wellness plan directly to the student.
2828 SECTION 2. Section 38.103, Education Code, is amended by
2929 adding Subsection (a-1) to read as follows:
3030 (a-1) A school district shall provide a parent with a copy
3131 of the results of the physical assessment of the parent's child if
3232 the results are below the standards identified in accordance with
3333 Section 38.102(b)(2).
3434 SECTION 3. This Act applies beginning with the 2015-2016
3535 school year.
3636 SECTION 4. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2015.
