| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Article 20.22(b), Code of Criminal Procedure, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (b) If the defendant is not in custody or under bond at the | |
| 13 | 13 | time of the presentment of indictment, the indictment may not be | |
| 14 | 14 | made public [and the entry in the record of the court relating to | |
| 15 | 15 | the indictment must be delayed] until the capias is served and the | |
| 16 | 16 | defendant is placed in custody or under bond. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2015. |
