64 AN ACT
75 relating to requirements for certain farm vehicles when operating
86 on a highway.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 541.201(6), Transportation Code, is
119 amended to read as follows:
1210 (6) "Implement of husbandry" means:
1311 (A) a vehicle, other than a passenger car or
1412 truck, that is designed and adapted for use as a farm implement,
1513 machinery, or tool for tilling the soil;
1614 (B) a towed vehicle that transports to the field
1715 and spreads fertilizer or agricultural chemicals; or
1816 (C) a motor vehicle designed and adapted to
1917 deliver feed to livestock.
2018 SECTION 2. Section 622.901, Transportation Code, is amended
2119 to read as follows:
2220 Sec. 622.901. WIDTH EXCEPTIONS. (a) In this section,
2321 "farm tractor" and "implement of husbandry" have the meanings
2422 assigned by Section 541.201.
2523 (b) The width limitation provided by Section 621.201 does
2624 not apply to:
2725 (1) highway building or maintenance machinery that is
2826 traveling:
2927 (A) during daylight on a public highway other
3028 than a highway that is part of the national system of interstate and
3129 defense highways; or
3230 (B) for not more than 50 miles on a highway that
3331 is part of the national system of interstate and defense highways;
3432 (2) a vehicle traveling during daylight on a public
3533 highway other than a highway that is part of the national system of
3634 interstate and defense highways or traveling for not more than 50
3735 miles on a highway that is part of the national system of interstate
3836 and defense highways if the vehicle is:
3937 (A) a farm tractor or implement of husbandry; or
4038 (B) a vehicle on which a farm tractor or
4139 implement of husbandry, other than a tractor or implement being
4240 transported from one dealer to another, is being moved by the owner
4341 of the tractor or implement or by an agent or employee of the owner:
4442 (i) to deliver the tractor or implement to a
4543 new owner;
4644 (ii) to transport the tractor or implement
4745 to or from a mechanic for maintenance or repair; or
4846 (iii) in the course of an agricultural
4947 operation;
5048 (3) machinery that is used solely for drilling water
5149 wells, including machinery that is a unit or a unit mounted on a
5250 conventional vehicle or chassis, and that is traveling:
5351 (A) during daylight on a public highway other
5452 than a highway that is part of the national system of interstate and
5553 defense highways; or
5654 (B) for not more than 50 miles on a highway that
5755 is part of the national system of interstate and defense highways;
5856 (4) a vehicle owned or operated by a public, private,
5957 or volunteer fire department;
6058 (5) a vehicle registered under Section 502.431; or
6159 (6) a recreational vehicle to which Section 622.903
6260 applies.
6361 SECTION 3. This Act takes effect September 1, 2015.
