6	4		AN ACT
7	5		relating to requirements for certain farm vehicles when operating
8	6		on a highway.
9	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	8		SECTION 1. Section 541.201(6), Transportation Code, is
11	9		amended to read as follows:
12	10		(6) "Implement of husbandry" means:
13	11		(A) a vehicle, other than a passenger car or
14	12		truck, that is designed and adapted for use as a farm implement,
15	13		machinery, or tool for tilling the soil;
16	14		(B) a towed vehicle that transports to the field
17	15		and spreads fertilizer or agricultural chemicals; or
18	16		(C) a motor vehicle designed and adapted to
19	17		deliver feed to livestock.
20	18		SECTION 2. Section 622.901, Transportation Code, is amended
21	19		to read as follows:
22	20		Sec. 622.901. WIDTH EXCEPTIONS. (a) In this section,
23	21		"farm tractor" and "implement of husbandry" have the meanings
24	22		assigned by Section 541.201.
25	23		(b) The width limitation provided by Section 621.201 does
26	24		not apply to:
27	25		(1) highway building or maintenance machinery that is
28	26		traveling:
29	27		(A) during daylight on a public highway other
30	28		than a highway that is part of the national system of interstate and
31	29		defense highways; or
32	30		(B) for not more than 50 miles on a highway that
33	31		is part of the national system of interstate and defense highways;
34	32		(2) a vehicle traveling during daylight on a public
35	33		highway other than a highway that is part of the national system of
36	34		interstate and defense highways or traveling for not more than 50
37	35		miles on a highway that is part of the national system of interstate
38	36		and defense highways if the vehicle is:
39	37		(A) a farm tractor or implement of husbandry; or
40	38		(B) a vehicle on which a farm tractor or
41	39		implement of husbandry, other than a tractor or implement being
42	40		transported from one dealer to another, is being moved by the owner
43	41		of the tractor or implement or by an agent or employee of the owner:
44	42		(i) to deliver the tractor or implement to a
45	43		new owner;
46	44		(ii) to transport the tractor or implement
47	45		to or from a mechanic for maintenance or repair; or
48	46		(iii) in the course of an agricultural
49	47		operation;
50	48		(3) machinery that is used solely for drilling water
51	49		wells, including machinery that is a unit or a unit mounted on a
52	50		conventional vehicle or chassis, and that is traveling:
53	51		(A) during daylight on a public highway other
54	52		than a highway that is part of the national system of interstate and
55	53		defense highways; or
56	54		(B) for not more than 50 miles on a highway that
57	55		is part of the national system of interstate and defense highways;
58	56		(4) a vehicle owned or operated by a public, private,
59	57		or volunteer fire department;
60	58		(5) a vehicle registered under Section 502.431; or
61	59		(6) a recreational vehicle to which Section 622.903
62	60		applies.
63	61		SECTION 3. This Act takes effect September 1, 2015.
