| 7 | 7 | | relating to the residence address of a person for purposes of |
|---|
| 8 | 8 | | registration under the Election Code. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1, Election Code, is amended by adding |
|---|
| 11 | 11 | | Section 1.016 to read as follows: |
|---|
| 12 | 12 | | Sec. 1.016. RESIDENCE FOR CERTAIN REGISTERED VOTERS. |
|---|
| 13 | 13 | | (a) For purposes of registration under this code, a person's |
|---|
| 14 | 14 | | residence is established at the first residence address in the |
|---|
| 15 | 15 | | following list that is applicable to the person: |
|---|
| 16 | 16 | | (1) the address stated on a driver's license issued to |
|---|
| 17 | 17 | | the person by the Department of Public Safety that has not expired |
|---|
| 18 | 18 | | or, if the person has notified the department of a change of address |
|---|
| 19 | 19 | | under Section 521.054, Transportation Code, the new address |
|---|
| 20 | 20 | | contained in the notification; |
|---|
| 21 | 21 | | (2) the address stated on a personal identification |
|---|
| 22 | 22 | | card issued to the person by the Department of Public Safety that |
|---|
| 23 | 23 | | has not expired or, if the person has notified the department of a |
|---|
| 24 | 24 | | change of address under Section 521.054, Transportation Code, the |
|---|
| 25 | 25 | | new address contained in the notification; |
|---|
| 26 | 26 | | (3) the address stated on a license to carry a |
|---|
| 27 | 27 | | concealed handgun issued to the person by the Department of Public |
|---|
| 28 | 28 | | Safety that has not expired or, if the person has notified the |
|---|
| 29 | 29 | | department of a change of address under Section 411.181, Government |
|---|
| 30 | 30 | | Code, the new address contained in the notification; |
|---|
| 31 | 31 | | (4) an address corresponding to a residence at which |
|---|
| 32 | 32 | | the person receives mail; |
|---|
| 33 | 33 | | (5) the address the person claims as a homestead in |
|---|
| 34 | 34 | | this state; or |
|---|
| 35 | 35 | | (6) the registration address of a vehicle the person |
|---|
| 36 | 36 | | owns. |
|---|
| 37 | 37 | | (b) A person whose residence in this state has no address |
|---|
| 38 | 38 | | may establish residence under this section by executing an |
|---|
| 39 | 39 | | affidavit stating that the person's residence in this state has no |
|---|
| 40 | 40 | | address and filing the affidavit with the secretary of state. |
|---|
| 41 | 41 | | (c) The address described by Subsection (a)(4) may not be a |
|---|
| 42 | 42 | | commercial post office box or similar location that does not |
|---|
| 43 | 43 | | correspond to a residence. |
|---|
| 44 | 44 | | (d) This section does not apply to: |
|---|
| 45 | 45 | | (1) a person who is a member of the armed forces of the |
|---|
| 46 | 46 | | United States or the spouse or a dependent of a member; or |
|---|
| 47 | 47 | | (2) a person enrolled as a full-time student at an |
|---|
| 48 | 48 | | institution of higher education. |
|---|
| 49 | 49 | | (e) The secretary of state shall adopt rules as necessary to |
|---|
| 50 | 50 | | implement this section. |
|---|
| 51 | 51 | | SECTION 2. This Act takes effect September 1, 2015. |
