55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the residence address of a person for purposes of
88 registration under the Election Code.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1, Election Code, is amended by adding
1111 Section 1.016 to read as follows:
1212 Sec. 1.016. RESIDENCE FOR CERTAIN REGISTERED VOTERS.
1313 (a) For purposes of registration under this code, a person's
1414 residence is established at the first residence address in the
1515 following list that is applicable to the person:
1616 (1) the address stated on a driver's license issued to
1717 the person by the Department of Public Safety that has not expired
1818 or, if the person has notified the department of a change of address
1919 under Section 521.054, Transportation Code, the new address
2020 contained in the notification;
2121 (2) the address stated on a personal identification
2222 card issued to the person by the Department of Public Safety that
2323 has not expired or, if the person has notified the department of a
2424 change of address under Section 521.054, Transportation Code, the
2525 new address contained in the notification;
2626 (3) the address stated on a license to carry a
2727 concealed handgun issued to the person by the Department of Public
2828 Safety that has not expired or, if the person has notified the
2929 department of a change of address under Section 411.181, Government
3030 Code, the new address contained in the notification;
3131 (4) an address corresponding to a residence at which
3232 the person receives mail;
3333 (5) the address the person claims as a homestead in
3434 this state; or
3535 (6) the registration address of a vehicle the person
3636 owns.
3737 (b) A person whose residence in this state has no address
3838 may establish residence under this section by executing an
3939 affidavit stating that the person's residence in this state has no
4040 address and filing the affidavit with the secretary of state.
4141 (c) The address described by Subsection (a)(4) may not be a
4242 commercial post office box or similar location that does not
4343 correspond to a residence.
4444 (d) This section does not apply to:
4545 (1) a person who is a member of the armed forces of the
4646 United States or the spouse or a dependent of a member; or
4747 (2) a person enrolled as a full-time student at an
4848 institution of higher education.
4949 (e) The secretary of state shall adopt rules as necessary to
5050 implement this section.
5151 SECTION 2. This Act takes effect September 1, 2015.
