9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 39.905, Utilities Code, is amended by | |
11 | 11 | adding Subsection (l) to read as follows: | |
12 | 12 | (l) As part of an electric utility's energy efficiency | |
13 | 13 | incentive programs, an electric utility in conjunction with a | |
14 | 14 | municipally owned water utility may design and implement a pilot | |
15 | 15 | program to measure energy savings achieved as a result of the | |
16 | 16 | implementation of one or more water conservation programs | |
17 | 17 | administered by the water utility. The electric utility may | |
18 | 18 | recover reasonable costs for the program through its energy | |
19 | 19 | efficiency cost recovery factor under Subsection (b)(1) in addition | |
20 | 20 | to the costs the electric utility would have otherwise recovered | |
21 | 21 | through the energy efficiency cost recovery factor. | |
22 | 22 | SECTION 2. The Public Utility Commission of Texas shall | |
23 | 23 | adopt rules as necessary to implement Section 39.905(l), Utilities | |
24 | 24 | Code, as added by this Act, not later than January 1, 2016. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2015. |
