| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. (a) This section takes effect only if the Act of |
|---|
| 11 | 11 | | the 84th Legislature, Regular Session, 2015, relating to |
|---|
| 12 | 12 | | nonsubstantive additions to and corrections in enacted codes |
|---|
| 13 | 13 | | becomes law. |
|---|
| 14 | 14 | | (b) Section 21.002, Estates Code, is amended to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | Sec. 21.002. CONSTRUCTION. (a) Except as provided by [this |
|---|
| 17 | 17 | | section,] Section 22.027[,] or [Section] 1002.023, Chapter 311, |
|---|
| 18 | 18 | | Government Code (Code Construction Act), applies to the |
|---|
| 19 | 19 | | construction of a provision of this code. |
|---|
| 20 | 20 | | (b) This code and the Texas Probate Code, as amended, shall |
|---|
| 21 | 21 | | be considered one continuous statute, and for the purposes of any |
|---|
| 22 | 22 | | instrument that refers to the Texas Probate Code, this code shall be |
|---|
| 23 | 23 | | considered an amendment to the Texas Probate Code [Chapter 311, |
|---|
| 24 | 24 | | Government Code (Code Construction Act), does not apply to the |
|---|
| 25 | 25 | | construction of a provision of Subtitle X, Title 2, or Subtitle Y or |
|---|
| 26 | 26 | | Z, Title 3]. |

| 27 | 27 | | SECTION 2. (a) This section takes effect only if the Act of |
|---|
| 28 | 28 | | the 84th Legislature, Regular Session, 2015, relating to |
|---|
| 29 | 29 | | nonsubstantive additions to and corrections in enacted codes does |
|---|
| 30 | 30 | | not become law. |
|---|
| 31 | 31 | | (b) Section 21.002, Estates Code, is amended by adding |
|---|
| 32 | 32 | | Subsection (c) to read as follows: |
|---|
| 33 | 33 | | (c) This code and the Texas Probate Code, as amended, shall |
|---|
| 34 | 34 | | be considered one continuous statute, and for the purposes of any |
|---|
| 35 | 35 | | instrument that refers to the Texas Probate Code, this code shall be |
|---|
| 36 | 36 | | considered an amendment to the Texas Probate Code. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2015. |
