66 AN ACT
77 relating to the relationship between the Estates Code and the
88 former Texas Probate Code.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) This section takes effect only if the Act of
1111 the 84th Legislature, Regular Session, 2015, relating to
1212 nonsubstantive additions to and corrections in enacted codes
1313 becomes law.
1414 (b) Section 21.002, Estates Code, is amended to read as
1515 follows:
1616 Sec. 21.002. CONSTRUCTION. (a) Except as provided by [this
1717 section,] Section 22.027[,] or [Section] 1002.023, Chapter 311,
1818 Government Code (Code Construction Act), applies to the
1919 construction of a provision of this code.
2020 (b) This code and the Texas Probate Code, as amended, shall
2121 be considered one continuous statute, and for the purposes of any
2222 instrument that refers to the Texas Probate Code, this code shall be
2323 considered an amendment to the Texas Probate Code [Chapter 311,
2424 Government Code (Code Construction Act), does not apply to the
2525 construction of a provision of Subtitle X, Title 2, or Subtitle Y or
2626 Z, Title 3].
2727 SECTION 2. (a) This section takes effect only if the Act of
2828 the 84th Legislature, Regular Session, 2015, relating to
2929 nonsubstantive additions to and corrections in enacted codes does
3030 not become law.
3131 (b) Section 21.002, Estates Code, is amended by adding
3232 Subsection (c) to read as follows:
3333 (c) This code and the Texas Probate Code, as amended, shall
3434 be considered one continuous statute, and for the purposes of any
3535 instrument that refers to the Texas Probate Code, this code shall be
3636 considered an amendment to the Texas Probate Code.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2015.
