55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring certain tax bills to
77 be approved by two-thirds of all the members elected to each house

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article VIII, Texas Constitution, is amended by
1111 adding Section 30 to read as follows:
1212 Sec. 30. (a) An affirmative record vote of two-thirds of
1313 all the members elected to each house of the legislature on final
1414 consideration in each house is required for passage of a bill that:
1515 (1) imposes a new state tax; or
1616 (2) increases the rate of an existing state tax above
1717 the rate in effect on the date the bill was filed.
1818 (b) This section does not apply to a bill that amends:
1919 (1) the manner in which a state tax is computed;
2020 (2) the manner in which a state tax is administered or
2121 enforced; or
2222 (3) the applicability of a state tax.
2323 (c) In this section, "state tax" does not include:
2424 (1) a tax or other levy imposed by a political
2525 subdivision of this state;
2626 (2) a fine, penalty, or interest charge;
2727 (3) a charge for a specific service, property, or
2828 other item in an amount that reasonably relates to the value of the
2929 service, property, or item; or
3030 (4) a fee, including a filing fee, license or
3131 registration fee, or application fee.
3232 SECTION 2. This proposed constitutional amendment shall be
3333 submitted to the voters at an election to be held November 3, 2015.
3434 The ballot shall be printed to permit voting for or against the
3535 proposition: "The constitutional amendment requiring a bill that
3636 imposes, or increases the rate of, a state tax to be approved by
3737 two-thirds of all the members elected to each house of the
3838 legislature."
