55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring the periodic review
77 of state and local tax preferences and providing an expiration date
88 for certain tax preferences.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article VIII, Texas Constitution, is amended by
1111 adding Section 31 to read as follows:
1212 Sec. 31. (a) The legislature by general law shall:
1313 (1) require the periodic review of state and local tax
1414 preferences;
1515 (2) define the term "tax preference" for the purposes
1616 of this section; and
1717 (3) prescribe the methods, timing, and administrative
1818 procedures for implementing the requirements of this subsection.
1919 (b) A tax preference that takes effect on or after September
2020 1, 2016, expires six years after the date the tax preference takes
2121 effect, except that the legislature may provide for an earlier or
2222 later expiration date.
2323 SECTION 2. The following temporary provision is added to
2424 the Texas Constitution:
2525 TEMPORARY PROVISION. (a) This temporary provision applies
2626 to the constitutional amendment proposed by the 84th Legislature,
2727 Regular Session, 2015, requiring the legislature to provide for a
2828 periodic review of state and local tax preferences and providing
2929 for the expiration of certain tax preferences six years after their
3030 effective dates or at another time prescribed by the legislature.
3131 (b) Section 31, Article VIII, of this constitution, as added
3232 by the amendment, takes effect January 1, 2016.
3333 (c) This temporary provision expires January 2, 2016.
3434 SECTION 3. This proposed constitutional amendment shall be
3535 submitted to the voters at an election to be held November 3, 2015.
3636 The ballot shall be printed to permit voting for or against the
3737 proposition: "The constitutional amendment requiring the
3838 legislature to provide for a periodic review of state and local tax
3939 preferences and providing for the expiration of certain tax
4040 preferences six years after their effective dates or at another
4141 time prescribed by the legislature."
