| 12 | 12 | | proposing a constitutional amendment dedicating certain revenue |

| 13 | 13 | | sources to be used for the acquisition of rights-of-way for and the |

| 14 | 14 | | construction and maintenance of public roadways. |

| 15 | 15 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Article VIII, Texas Constitution, is amended by |
|---|
| 17 | 17 | | adding Section 7-c to read as follows: |
|---|
| 18 | 18 | | Sec. 7-c. Subject to legislative appropriation, |
|---|
| 19 | 19 | | allocation, and direction, all net revenues remaining after payment |
|---|
| 20 | 20 | | of all refunds allowed by law and expenses of collection derived |
|---|
| 21 | 21 | | from the following sources shall be used only for the acquisition of |
|---|
| 22 | 22 | | rights-of-way for and the construction and maintenance of public |
|---|
| 23 | 23 | | roadways other than toll roads: |
|---|
| 24 | 24 | | (1) fees for permits that authorize a motor vehicle or |
|---|
| 25 | 25 | | combination of motor vehicles that exceed the weight or size limits |
|---|
| 26 | 26 | | allowed by this state to operate on a highway in this state; |
|---|
| 27 | 27 | | (2) payments received under a comprehensive |
|---|
| 28 | 28 | | development agreement for a toll project or system of the Texas |
|---|
| 29 | 29 | | Department of Transportation or its successor; |
|---|
| 30 | 30 | | (3) the sale or transfer of any interest in a highway |
|---|
| 31 | 31 | | right-of-way or real property acquired for a state highway purpose |
|---|
| 32 | 32 | | that is no longer needed for a state highway purpose; and |
|---|
| 33 | 33 | | (4) the sale of surplus motor vehicles by state |
|---|
| 34 | 34 | | agencies. |

| 35 | 35 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 36 | 36 | | submitted to the voters at an election to be held November 3, 2015. |
|---|
| 37 | 37 | | The ballot shall be printed to permit voting for or against the |
|---|
| 38 | 38 | | proposition: "The constitutional amendment dedicating certain |
|---|
| 39 | 39 | | revenue sources to be used for the acquisition of rights-of-way for |
|---|
| 40 | 40 | | and the construction and maintenance of public roadways." |
