55 A JOINT RESOLUTION
66 applying to the Congress of the United States to call a convention
77 under Article V of the United States Constitution for the limited
88 purpose of proposing one or more amendments to the constitution to
99 impose fiscal restraints on the federal government, to limit the
1010 power and jurisdiction of the federal government, and to limit the
1111 terms of office of federal officials and members of Congress.
1212 WHEREAS, The drafters of the United States Constitution
1313 empowered state legislatures to be guardians of liberty against
1414 abuses of power by the federal government; and
1515 WHEREAS, The federal government has abused its power by
1616 creating a crushing national debt through improper and imprudent
1717 spending; and
1818 WHEREAS, The federal government has abused its power by
1919 invading the legitimate role of the states through the manipulative
2020 process of federal mandates that are to a great extent unfunded; and
2121 WHEREAS, The federal government has ceased to abide by a
2222 proper interpretation of the United States Constitution; and
2323 WHEREAS, It is the solemn duty of state legislatures to
2424 protect the liberty of the people and of future generations by
2525 proposing amendments to the United States Constitution that place
2626 clear restraints on federal power; and
2727 WHEREAS, Article V of the United States Constitution
2828 authorizes the several state legislatures to restrict the power of
2929 the federal government through the amendment process; and
3030 WHEREAS, Article V of the United States Constitution provides
3131 that on application of the legislatures of two-thirds of the
3232 several states Congress shall call a convention for the purpose of
3333 proposing amendments to the constitution; now, therefore, be it
3434 RESOLVED, That the 84th Texas Legislature apply to Congress
3535 to call a convention under Article V of the United States
3636 Constitution for the limited purpose of proposing one or more
3737 amendments to the constitution to impose fiscal restraints on the
3838 federal government, to limit the power and jurisdiction of the
3939 federal government, and to limit the terms of office of federal
4040 officials and members of Congress; and, be it further
4141 RESOLVED, That, unless rescinded by a succeeding
4242 legislature, this application by the 84th Texas Legislature
4343 constitutes a continuing application in accordance with Article V
4444 of the United States Constitution until at least two-thirds of the
4545 legislatures of the several states have applied to Congress to call
4646 a convention for the limited purpose of proposing one or more
4747 amendments to the constitution to impose fiscal restraints on the
4848 federal government, to limit the power and jurisdiction of the
4949 federal government, and to limit the terms of office of federal
5050 officials and members of Congress; and, be it further
5151 RESOLVED, That the Texas secretary of state forward official
5252 copies of this resolution to the president of the United States, to
5353 the speaker of the House of Representatives and the president of the
5454 Senate of the Congress of the United States, and to all members of
5555 the Texas delegation to Congress with the request that this
5656 resolution be officially entered in the Congressional Record as an
5757 application to Congress for a convention under Article V of the
5858 United States Constitution for the limited purpose of proposing one
5959 or more amendments to the constitution to impose fiscal restraints
6060 on the federal government, to limit the power and jurisdiction of
6161 the federal government, and to limit the terms of office of federal
6262 officials and members of Congress; and, be it further
6363 RESOLVED, That the Texas secretary of state forward official
6464 copies of this resolution to the secretaries of state and to the
6565 presiding officers of the legislatures of the several states with
6666 the request that they join this state in applying to Congress for a
6767 convention under Article V of the United States Constitution for
6868 the limited purpose of proposing one or more amendments to the
6969 constitution to impose fiscal restraints on the federal government,
7070 to limit the power and jurisdiction of the federal government, and
7171 to limit the terms of office of federal officials and members of
7272 Congress.
