5	5	A JOINT RESOLUTION
6	6	applying to the Congress of the United States to call a convention
7	7	under Article V of the United States Constitution for the limited
8	8	purpose of proposing one or more amendments to the constitution to
9	9	impose fiscal restraints on the federal government, to limit the
10	10	power and jurisdiction of the federal government, and to limit the
11	11	terms of office of federal officials and members of Congress.
12	12	WHEREAS, The drafters of the United States Constitution
13	13	empowered state legislatures to be guardians of liberty against
14	14	abuses of power by the federal government; and
15	15	WHEREAS, The federal government has abused its power by
16	16	creating a crushing national debt through improper and imprudent
17	17	spending; and
18	18	WHEREAS, The federal government has abused its power by
19	19	invading the legitimate role of the states through the manipulative
20	20	process of federal mandates that are to a great extent unfunded; and
21	21	WHEREAS, The federal government has ceased to abide by a
22	22	proper interpretation of the United States Constitution; and
23	23	WHEREAS, It is the solemn duty of state legislatures to
24	24	protect the liberty of the people and of future generations by
25	25	proposing amendments to the United States Constitution that place
26	26	clear restraints on federal power; and
27	27	WHEREAS, Article V of the United States Constitution
28	28	authorizes the several state legislatures to restrict the power of
29	29	the federal government through the amendment process; and
30	30	WHEREAS, Article V of the United States Constitution provides
31	31	that on application of the legislatures of two-thirds of the
32	32	several states Congress shall call a convention for the purpose of
33	33	proposing amendments to the constitution; now, therefore, be it
34	34	RESOLVED, That the 84th Texas Legislature apply to Congress
35	35	to call a convention under Article V of the United States
36	36	Constitution for the limited purpose of proposing one or more
37	37	amendments to the constitution to impose fiscal restraints on the
38	38	federal government, to limit the power and jurisdiction of the
39	39	federal government, and to limit the terms of office of federal
40	40	officials and members of Congress; and, be it further
41	41	RESOLVED, That, unless rescinded by a succeeding
42	42	legislature, this application by the 84th Texas Legislature
43	43	constitutes a continuing application in accordance with Article V
44	44	of the United States Constitution until at least two-thirds of the
45	45	legislatures of the several states have applied to Congress to call
46	46	a convention for the limited purpose of proposing one or more
47	47	amendments to the constitution to impose fiscal restraints on the
48	48	federal government, to limit the power and jurisdiction of the
49	49	federal government, and to limit the terms of office of federal
50	50	officials and members of Congress; and, be it further
51	51	RESOLVED, That the Texas secretary of state forward official
52	52	copies of this resolution to the president of the United States, to
53	53	the speaker of the House of Representatives and the president of the
54	54	Senate of the Congress of the United States, and to all members of
55	55	the Texas delegation to Congress with the request that this
56	56	resolution be officially entered in the Congressional Record as an
57	57	application to Congress for a convention under Article V of the
58	58	United States Constitution for the limited purpose of proposing one
59	59	or more amendments to the constitution to impose fiscal restraints
60	60	on the federal government, to limit the power and jurisdiction of
61	61	the federal government, and to limit the terms of office of federal
62	62	officials and members of Congress; and, be it further
63	63	RESOLVED, That the Texas secretary of state forward official
64	64	copies of this resolution to the secretaries of state and to the
65	65	presiding officers of the legislatures of the several states with
66	66	the request that they join this state in applying to Congress for a
67	67	convention under Article V of the United States Constitution for
68	68	the limited purpose of proposing one or more amendments to the
69	69	constitution to impose fiscal restraints on the federal government,
70	70	to limit the power and jurisdiction of the federal government, and
71	71	to limit the terms of office of federal officials and members of
72	72	Congress.
