5	5	BE IT RESOLVED by the Senate of the State of Texas, 84th
6	6	Legislature, Regular Session, 2015, That Senate Rule 12.03 be
7	7	suspended in part as provided by Senate Rule 12.08 to enable the
8	8	conference committee appointed to resolve the differences on
9	9	House Bill 3123 (governmental entities subject to the sunset
10	10	process) to consider and take action on the following matters:
11	11	(1) Senate Rule 12.03(2) is suspended to permit the
12	12	committee to omit text which is not in disagreement, SECTION 2.01
13	13	of the house engrossment of House Bill No. 3123 and the
14	14	corresponding section of the bill as the bill was amended by the
15	15	senate, relating to the sunset review of the Sulphur River Basin
16	16	Authority, that reads:
17	17	SECTION 2.01. SULPHUR RIVER BASIN AUTHORITY. Section 1A,
18	18	Chapter 3, Acts of the 69th Legislature, 1st Called Session,
19	19	1985, is repealed.
20	20	Explanation: The omission is necessary to continue the
21	21	sunset review of the Sulphur River Basin Authority.
22	22	(2) Senate Rule 12.03(4) is suspended to permit the
23	23	committee to add text on matters not included in either the house
24	24	or senate version of the bill by adding the following:
25	25	ARTICLE 1. ENTITIES GIVEN 2017 SUNSET DATE
26	26	SECTION 1.01. TEXAS DEPARTMENT OF TRANSPORTATION.
27	27	Section 201.204, Transportation Code, is amended to read as
28	28	follows:
29	29	Sec. 201.204. SUNSET PROVISION. (a) The Texas Department
30	30	of Transportation is subject to Chapter 325, Government Code
31	31	(Texas Sunset Act). Unless continued in existence as provided by
32	32	that chapter, the department is abolished September 1, 2017.
33	33	(b) The Sunset Advisory Commission shall limit its review
34	34	of the Texas Department of Transportation in preparation for the
35	35	work of the 85th Legislature in Regular Session to the
36	36	department's project planning, selection, programming, and
37	37	funding processes and its interactions with local transportation
38	38	entities. In the commission's report to the 85th Legislature,
39	39	the commission may include any recommendations it considers
40	40	appropriate. This subsection expires September 1, 2017.
41	41	SECTION 1.02. NORTH TEXAS TOLLWAY AUTHORITY.
42	42	Subchapter A, Chapter 366, Transportation Code, is amended by
43	43	adding Section 366.005 to read as follows:
44	44	Sec. 366.005. SUNSET PROVISION. (a) An authority is
45	45	subject to review under Chapter 325, Government Code (Texas
46	46	Sunset Act), as if it were a state agency but is not abolished
47	47	under that chapter.
48	48	(b) An authority shall be reviewed during the period in
49	49	which state agencies scheduled to be reviewed or abolished in
50	50	2017 are reviewed.
51	51	(c) An authority shall pay the cost incurred by the
52	52	Sunset Advisory Commission in performing a review of the
53	53	authority under this section. The Sunset Advisory Commission
54	54	shall determine the cost, and the authority shall pay the amount
55	55	promptly on receipt of a statement from the Sunset Advisory
56	56	Commission detailing the cost.
57	57	(d) This section expires September 1, 2017.
58	58	ARTICLE 2. ENTITIES GIVEN 2019 SUNSET DATE
59	59	SECTION 2.01. EMPLOYEES RETIREMENT SYSTEM OF TEXAS.
60	60	Section 815.005, Government Code, is amended to read as follows:
61	61	Sec. 815.005. SUNSET PROVISION. The board of trustees of
62	62	the Employees Retirement System of Texas is subject to review
63	63	under Chapter 325 (Texas Sunset Act), but is not abolished under
64	64	that chapter. The board shall be reviewed during the period in
65	65	which state agencies abolished in 2019 [2017], and every 12th
66	66	year after that year, are reviewed.
67	67	SECTION 4.04. TEXAS MILITARY DEPARTMENT. Section
68	68	437.051, Government Code, is amended to read as follows:
69	69	Sec. 437.051. SUNSET PROVISION. The department is
70	70	subject to Chapter 325 (Texas Sunset Act). Unless continued in
71	71	existence as provided by that chapter, the department is
72	72	abolished and this subchapter expires September 1, 2023 [2019].
73	73	SECTION 4.05. CANCER PREVENTION AND RESEARCH INSTITUTE
74	74	OF TEXAS. Section 102.003, Health and Safety Code, is amended to
75	75	read as follows:
76	76	Sec. 102.003. SUNSET PROVISION. The Cancer Prevention
77	77	and Research Institute of Texas is subject to Chapter 325,
78	78	Government Code (Texas Sunset Act). Unless continued in
79	79	existence as provided by that chapter, the institute is abolished
80	80	and this chapter expires September 1, 2023 [2021].
81	81	SECTION 4.06. RAILROAD COMMISSION OF TEXAS. Sections
82	82	81.01001(a) and (a-1), Natural Resources Code, are amended to
83	83	read as follows:
84	84	(a) The Railroad Commission of Texas is subject to
85	85	Chapter 325, Government Code (Texas Sunset Act). Unless
86	86	continued in existence as provided by that chapter, the
87	87	commission is abolished September 1, 2023 [2017].
88	88	(a-1) The review of the Railroad Commission of Texas by
89	89	the Sunset Advisory Commission in preparation for the work of the
90	90	88th [85th] Legislature in Regular Session is not limited to the
91	91	appropriateness of recommendations made by the Sunset Advisory
92	92	Commission to the 83rd Legislature. In the Sunset Advisory
93	93	Commission's report to the 88th [85th] Legislature, the Sunset
94	94	Advisory Commission may include any recommendations it considers
95	95	appropriate. The review must include an examination of
96	96	alternative organizational structures for the Railroad
97	97	Commission of Texas and alternative methods for performing the
98	98	commission's responsibilities that would enable the efficient
99	99	and effective accomplishment of the commission's functions. The
100	100	examination must include an assessment of existing state
101	101	agencies that would be able to perform the commission's
102	102	functions. The review must also include an examination of
103	103	methods to increase the public's role in decisions of the
104	104	Railroad Commission of Texas that relate to the effect of the
105	105	growth of resource extraction. The Sunset Advisory Commission
106	106	may contract for assistance in performing the review, including
107	107	assistance in evaluating, auditing, and forensic auditing, as
108	108	the Sunset Advisory Commission determines necessary. This
109	109	subsection expires September 1, 2023 [2017].
110	110	Explanation: This addition is necessary to limit the
111	111	scope of the next sunset review of the Texas Department of
112	112	Transportation, to subject the North Texas Tollway Authority to
113	113	sunset review, and to change the sunset review date for various
114	114	state agencies.
