8 | 8 | | Safety to an applicant for a driver's license or personal |

9 | 9 | | identification certificate that may be used to show proof of voter |
---|
10 | 10 | | registration. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 20, Election Code, is |
---|
13 | 13 | | amended by adding Section 20.0631 to read as follows: |
---|
14 | 14 | | Sec. 20.0631. TRANSACTION RECEIPT. The Department of |
---|
15 | 15 | | Public Safety shall issue a transaction receipt to each qualifying |
---|
16 | 16 | | applicant for a driver's license or personal identification |
---|
17 | 17 | | certificate who completes a voter registration application as |
---|
18 | 18 | | provided by Section 20.063. The receipt must include: |
---|
19 | 19 | | (1) the applicant's name; |
---|
20 | 20 | | (2) the date of issuance of the receipt; |
---|
21 | 21 | | (3) a statement indicating that the applicant |
---|
22 | 22 | | submitted a voter registration application; and |
---|
23 | 23 | | (4) the following statement: "This receipt is proof of |
---|
24 | 24 | | your application for voter registration. Retain it until you |
---|
25 | 25 | | receive a voter registration certificate from your local voter |
---|
26 | 26 | | registrar. If you do not receive a voter registration certificate, |
---|
27 | 27 | | you may use this as proof that you submitted a timely voter |
---|
28 | 28 | | registration application." |

29 | 29 | | SECTION 2. Section 63.011, Election Code, is amended by |
---|
30 | 30 | | adding Subsection (f) to read as follows: |
---|
31 | 31 | | (f) A person who votes a provisional ballot solely because |
---|
32 | 32 | | the person's name was not on the list of registered voters for the |
---|
33 | 33 | | precinct in which the person voted may present a voter registration |
---|
34 | 34 | | receipt issued to the person under Section 20.0631 as proof that the |
---|
35 | 35 | | person is registered to vote in the precinct. An election officer |
---|
36 | 36 | | shall attach the receipt to the envelope containing the person's |
---|
37 | 37 | | provisional ballot. A person who does not present a voter |
---|
38 | 38 | | registration receipt at the time of voting a provisional ballot may |
---|
39 | 39 | | present the receipt to the voter registrar in the same manner as |
---|
40 | 40 | | presenting identification for a provisional ballot under Section |
---|
41 | 41 | | 65.0541. |
---|
42 | 42 | | SECTION 3. Section 65.054, Election Code, is amended by |
---|
43 | 43 | | adding Subsection (e) to read as follows: |
---|
44 | 44 | | (e) For purposes of Subsection (b)(1), a voter registration |
---|
45 | 45 | | receipt indicating the voter registered in the precinct in which |
---|
46 | 46 | | the voter voted that is attached to the envelope containing a |
---|
47 | 47 | | provisional ballot or presented to the voter registrar under |
---|
48 | 48 | | Section 63.011(f) is proof that a person who voted a provisional |
---|
49 | 49 | | ballot solely because the person's name was not on the list of |
---|
50 | 50 | | registered voters for the precinct in which the person voted is |
---|
51 | 51 | | eligible to vote in the election. The voter registrar shall amend |
---|
52 | 52 | | the list of registered voters accordingly. |
---|
53 | 53 | | SECTION 4. This Act takes effect September 1, 2017. |
