66 AN ACT
77 relating to the issuance of a receipt by the Department of Public
88 Safety to an applicant for a driver's license or personal
99 identification certificate that may be used to show proof of voter
1010 registration.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 20, Election Code, is
1313 amended by adding Section 20.0631 to read as follows:
1414 Sec. 20.0631. TRANSACTION RECEIPT. The Department of
1515 Public Safety shall issue a transaction receipt to each qualifying
1616 applicant for a driver's license or personal identification
1717 certificate who completes a voter registration application as
1818 provided by Section 20.063. The receipt must include:
1919 (1) the applicant's name;
2020 (2) the date of issuance of the receipt;
2121 (3) a statement indicating that the applicant
2222 submitted a voter registration application; and
2323 (4) the following statement: "This receipt is proof of
2424 your application for voter registration. Retain it until you
2525 receive a voter registration certificate from your local voter
2626 registrar. If you do not receive a voter registration certificate,
2727 you may use this as proof that you submitted a timely voter
2828 registration application."
2929 SECTION 2. Section 63.011, Election Code, is amended by
3030 adding Subsection (f) to read as follows:
3131 (f) A person who votes a provisional ballot solely because
3232 the person's name was not on the list of registered voters for the
3333 precinct in which the person voted may present a voter registration
3434 receipt issued to the person under Section 20.0631 as proof that the
3535 person is registered to vote in the precinct. An election officer
3636 shall attach the receipt to the envelope containing the person's
3737 provisional ballot. A person who does not present a voter
3838 registration receipt at the time of voting a provisional ballot may
3939 present the receipt to the voter registrar in the same manner as
4040 presenting identification for a provisional ballot under Section
4141 65.0541.
4242 SECTION 3. Section 65.054, Election Code, is amended by
4343 adding Subsection (e) to read as follows:
4444 (e) For purposes of Subsection (b)(1), a voter registration
4545 receipt indicating the voter registered in the precinct in which
4646 the voter voted that is attached to the envelope containing a
4747 provisional ballot or presented to the voter registrar under
4848 Section 63.011(f) is proof that a person who voted a provisional
4949 ballot solely because the person's name was not on the list of
5050 registered voters for the precinct in which the person voted is
5151 eligible to vote in the election. The voter registrar shall amend
5252 the list of registered voters accordingly.
5353 SECTION 4. This Act takes effect September 1, 2017.
