| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 708, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 708.160 to read as follows: |

| 12 | 12 | | Sec. 708.160. DEFERRAL AND REDUCTION OR WAIVER OF CERTAIN |
|---|
| 13 | 13 | | SURCHARGES. A court may defer surcharges assessed under this |
|---|
| 14 | 14 | | chapter against a person who is participating in a drug court |
|---|
| 15 | 15 | | program under Chapter 123, Government Code, for the underlying |
|---|
| 16 | 16 | | offense giving rise to the surcharge. If a person successfully |
|---|
| 17 | 17 | | completes the drug court program, the court may reduce or waive the |
|---|
| 18 | 18 | | surcharges assessed against the person. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 20 | 20 | | surcharge pending on the effective date of this Act, regardless of |
|---|
| 21 | 21 | | when the surcharge was assessed. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2017. |
