66 AN ACT
77 relating to informed consent to immunizations for children.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 32.102(a) and (c), Family Code, are
1010 amended to read as follows:
1111 (a) Before administering an immunization to a child, a
1212 health care provider must obtain the informed consent of a [A]
1313 person authorized to consent to [the] immunization of the [a] child
1414 [has the responsibility to ensure that the consent, if given, is an
1515 informed consent]. The person authorized to consent is not
1616 required to be present when [the] immunization of the child is
1717 requested if a consent form that meets the requirements of Section
1818 32.002 has been given to the health care provider.
1919 (c) As part of the information given in the counseling for
2020 informed consent, the health care provider shall provide
2121 [information to inform] the person authorized to consent to
2222 immunization information regarding:
2323 (1) the benefits and risks of immunization, including
2424 any vaccine information statement required by the National
2525 Childhood Vaccine Injury Act of 1986 (42 U.S.C. Section 300aa-1 et
2626 seq.);
2727 (2) [of] the procedures available under the National
2828 Childhood Vaccine Injury Act of 1986 (42 U.S.C. Section 300aa-1 et
2929 seq.) to seek possible recovery for unreimbursed expenses for
3030 certain injuries arising out of the administration of certain
3131 vaccines; and
3232 (3) the vaccine excipient and media summary published
3333 by the Centers for Disease Control and Prevention for each
3434 immunization to be administered.
3535 SECTION 2. This Act takes effect September 1, 2017.
