97 relating to the review of certain privately operated residential
108 facilities for persons released on parole or to mandatory
119 supervision.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. DEFINITIONS. In this Act:
1412 (1) "Department" means the Texas Department of
1513 Criminal Justice.
1614 (2) "Releasee" means a person released on parole or to
1715 mandatory supervision.
1816 SECTION 2. REVIEW OF RESIDENTIAL FACILITIES. (a) The
1917 department shall review instances in which a releasee has absconded
2018 from supervision while being housed in a facility that is:
2119 (1) operated under contract with the department; and
2220 (2) located in a county that has a population of
2321 800,000 or more and is located on the international border.
2422 (b) The department shall analyze the factors that
2523 contribute to releasees absconding, including to what extent a rate
2624 of absconsion from a particular facility that exceeds the statewide
2725 average for all facilities is attributable to the types of
2826 releasees residing in the facility or to issues related to the staff
2927 of the facility.
3028 (c) The department shall make recommendations regarding:
3129 (1) improvements to the procedures used by the
3230 department to:
3331 (A) assess whether a releasee is likely to
3432 abscond from supervision; and
3533 (B) identify the appropriate residence for a
3634 releasee; and
3735 (2) legislative changes to the department's
3836 contracting powers, including any provisions to:
3937 (A) determine the most suitable private vendors
4038 with which to contract for the housing, supervision, and
4139 programmatic support of releasees; and
4240 (B) establish minimum requirements for the
4341 staffing of any facility housing releasees under a contract with
4442 the department.
4543 SECTION 3. REPORT. Not later than December 1, 2018, the
4644 department shall report the results of the review and analysis
4745 required by Section 2 of this Act and make recommendations to the
4846 governor, the lieutenant governor, the speaker of the house of
4947 representatives, and the standing legislative committees with
5048 primary jurisdiction over the department.
5149 SECTION 4. ASSISTANCE BY BOARD OF PARDONS AND PAROLES. On
5250 request of the department, the Board of Pardons and Paroles shall
5351 provide information to the department or otherwise assist the
5452 department in conducting the review and preparing the report
5553 required by this Act.
5654 SECTION 5. EXPIRATION. This Act expires June 1, 2019.
5755 SECTION 6. EFFECTIVE DATE. This Act takes effect September
5856 1, 2017.
