| 7 | 7 | | relating to the dissolution of a special utility district after the |
|---|
| 8 | 8 | | transfer of all obligations and services. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 65, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 65.7271 to read as follows: |
|---|
| 12 | 12 | | Sec. 65.7271. DISSOLUTION OF DISTRICT FOLLOWING TRANSFER OF |
|---|
| 13 | 13 | | ALL OBLIGATIONS AND SERVICES. The board may propose to dissolve the |
|---|
| 14 | 14 | | district and issue notice of a hearing on the proposed dissolution |
|---|
| 15 | 15 | | if the district's: |
|---|
| 16 | 16 | | (1) certificate of convenience has been transferred to |
|---|
| 17 | 17 | | another political subdivision; and |
|---|
| 18 | 18 | | (2) assets and liabilities have been transferred to or |
|---|
| 19 | 19 | | assumed by another political subdivision. |
|---|
| 20 | 20 | | SECTION 2. Section 65.730, Water Code, is amended to read as |
|---|
| 21 | 21 | | follows: |
|---|
| 22 | 22 | | Sec. 65.730. BOARD'S ORDER TO DISSOLVE DISTRICT. (a) For a |
|---|
| 23 | 23 | | dissolution hearing ordered under Section 65.727, if [If] the board |
|---|
| 24 | 24 | | unanimously determines from the evidence that the best interests of |
|---|
| 25 | 25 | | the persons and property in the district will be served by |
|---|
| 26 | 26 | | dissolving the district, the board shall enter the appropriate |
|---|
| 27 | 27 | | findings and order in its records dissolving the district. |
|---|
| 28 | 28 | | Otherwise the board shall enter its order providing that the |
|---|
| 29 | 29 | | district has not been dissolved. |
|---|
| 30 | 30 | | (b) For a dissolution hearing ordered under Section |
|---|
| 31 | 31 | | 65.7271, if two-thirds or more of the members of the board vote to |
|---|
| 32 | 32 | | dissolve the district, the board shall enter the appropriate |
|---|
| 33 | 33 | | findings and order in its records dissolving the district. |
|---|
| 34 | 34 | | Otherwise the board shall enter its order providing that the |
|---|
| 35 | 35 | | district has not been dissolved. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2017. |
