55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the dissolution of a special utility district after the
88 transfer of all obligations and services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 65, Water Code, is amended
1111 by adding Section 65.7271 to read as follows:
1212 Sec. 65.7271. DISSOLUTION OF DISTRICT FOLLOWING TRANSFER OF
1313 ALL OBLIGATIONS AND SERVICES. The board may propose to dissolve the
1414 district and issue notice of a hearing on the proposed dissolution
1515 if the district's:
1616 (1) certificate of convenience has been transferred to
1717 another political subdivision; and
1818 (2) assets and liabilities have been transferred to or
1919 assumed by another political subdivision.
2020 SECTION 2. Section 65.730, Water Code, is amended to read as
2121 follows:
2222 Sec. 65.730. BOARD'S ORDER TO DISSOLVE DISTRICT. (a) For a
2323 dissolution hearing ordered under Section 65.727, if [If] the board
2424 unanimously determines from the evidence that the best interests of
2525 the persons and property in the district will be served by
2626 dissolving the district, the board shall enter the appropriate
2727 findings and order in its records dissolving the district.
2828 Otherwise the board shall enter its order providing that the
2929 district has not been dissolved.
3030 (b) For a dissolution hearing ordered under Section
3131 65.7271, if two-thirds or more of the members of the board vote to
3232 dissolve the district, the board shall enter the appropriate
3333 findings and order in its records dissolving the district.
3434 Otherwise the board shall enter its order providing that the
3535 district has not been dissolved.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2017.
