55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to statutes of repose for certain claims involving the
88 construction or repair of an improvement to real property or the
99 attachment of equipment to real property.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 16.008(a) and (c), Civil Practice and
1212 Remedies Code, are amended to read as follows:
1313 (a) A person must bring suit for damages for a claim listed
1414 in Subsection (b) against a registered or licensed architect,
1515 engineer, interior designer, or landscape architect in this state,
1616 who designs, plans, or inspects the construction of an improvement
1717 to real property or equipment attached to real property, not later
1818 than five [10] years after the substantial completion of the
1919 improvement or the beginning of operation of the equipment in an
2020 action arising out of a defective or unsafe condition of the real
2121 property, the improvement, or the equipment.
2222 (c) If the claimant presents a written claim for damages,
2323 contribution, or indemnity to the architect, engineer, interior
2424 designer, or landscape architect within the five-year [10-year]
2525 limitations period, the period is extended for two years from the
2626 day the claim is presented.
2727 SECTION 2. Sections 16.009(a), (c), and (d), Civil Practice
2828 and Remedies Code, are amended to read as follows:
2929 (a) A claimant must bring suit for damages for a claim
3030 listed in Subsection (b) against a person who constructs or repairs
3131 an improvement to real property not later than five [10] years after
3232 the substantial completion of the improvement in an action arising
3333 out of a defective or unsafe condition of the real property or a
3434 deficiency in the construction or repair of the improvement.
3535 (c) If the claimant presents a written claim for damages,
3636 contribution, or indemnity to the person performing or furnishing
3737 the construction or repair work during the five-year [10-year]
3838 limitations period, the period is extended for two years from the
3939 date the claim is presented.
4040 (d) If the damage, injury, or death occurs during the fifth
4141 [10th] year of the limitations period, the claimant may bring suit
4242 not later than two years after the day the cause of action accrues.
4343 SECTION 3. (a) Except as provided by this section, Section
4444 16.008, Property Code, as amended by this Act, applies to a cause of
4545 action arising out of a design, plan, or inspection of the
4646 construction of an improvement to real property or equipment
4747 attached to real property that commences on or after the effective
4848 date of this Act. Section 16.008, Property Code, as amended by this
4949 Act, does not apply to a cause of action arising out of a design,
5050 plan, or inspection that commences on or after the effective date of
5151 this Act under a contract entered into before that date.
5252 (b) A cause of action arising out of a design, plan, or
5353 inspection of the construction of an improvement to real property
5454 or equipment attached to real property that commenced before the
5555 effective date of this Act or arising out of a design, plan, or
5656 inspection of the construction of an improvement to real property
5757 or equipment attached to real property that commences on or after
5858 the effective date of this Act under a contract entered into before
5959 that date is governed by the law applicable to the cause of action
6060 immediately before the effective date of this Act, and that law is
6161 continued in effect for that purpose.
6262 SECTION 4. (a) Except as provided by this section, Section
6363 16.009, Property Code, as amended by this Act, applies to a cause of
6464 action arising out of construction or repair of an improvement to
6565 real property that commences on or after the effective date of this
6666 Act. Section 16.009, Property Code, as amended by this Act, does
6767 not apply to a cause of action arising out of construction or repair
6868 of an improvement to real property that commences on or after the
6969 effective date of this Act under a contract entered into before that
7070 date.
7171 (b) A cause of action arising out of construction or repair
7272 of an improvement to real property that commenced before the
7373 effective date of this Act or arising out of construction or repair
7474 of an improvement to real property that commences on or after the
7575 effective date of this Act under a contract entered into before that
7676 date is governed by the law applicable to the cause of action
7777 immediately before the effective date of this Act, and that law is
7878 continued in effect for that purpose.
7979 SECTION 5. This Act takes effect September 1, 2017.
