66 AN ACT
77 relating to the required vote by a presidential elector; providing
88 a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 192, Election Code, is
1111 amended by adding Section 192.009 to read as follows:
1212 Sec. 192.009. REQUIRED VOTE BY ELECTOR. (a) At the meeting
1313 of electors, an elector shall vote for the candidates for president
1414 and vice president receiving the most votes in the general election
1515 for state and county officers of this state.
1616 (b) An elector who violates Subsection (a) commits an
1717 offense. An offense under this subsection is a state jail felony.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2017.
