55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to including fetal development instruction as part of the
88 health curriculum used in public schools in certain grade levels.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002, Education Code, is amended by
1111 adding Subsection (y) to read as follows:
1212 (y) The State Board of Education shall adopt rules requiring
1313 students enrolled in grade levels seven and eight to receive
1414 instruction on fetal development as part of the essential knowledge
1515 and skills for the health curriculum under Subsection (a)(2)(B).
1616 The instruction must include:
1717 (1) information on:
1818 (A) the human reproductive process, pregnancy,
1919 and infertility;
2020 (B) establishing healthy life skills; and
2121 (C) preventing birth defects, including
2222 information on the effect of drugs, alcohol, and environmental
2323 hazards, including lead; and
2424 (2) a description of the growth and development of an
2525 unborn child that occur during each trimester of pregnancy.
2626 SECTION 2. This Act applies beginning with the 2017-2018
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
