| 7 | 7 | | relating to including fetal development instruction as part of the |

| 8 | 8 | | health curriculum used in public schools in certain grade levels. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 28.002, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (y) to read as follows: |
|---|
| 12 | 12 | | (y) The State Board of Education shall adopt rules requiring |
|---|
| 13 | 13 | | students enrolled in grade levels seven and eight to receive |
|---|
| 14 | 14 | | instruction on fetal development as part of the essential knowledge |
|---|
| 15 | 15 | | and skills for the health curriculum under Subsection (a)(2)(B). |
|---|
| 16 | 16 | | The instruction must include: |
|---|
| 17 | 17 | | (1) information on: |
|---|
| 18 | 18 | | (A) the human reproductive process, pregnancy, |
|---|
| 19 | 19 | | and infertility; |
|---|
| 20 | 20 | | (B) establishing healthy life skills; and |
|---|
| 21 | 21 | | (C) preventing birth defects, including |
|---|
| 22 | 22 | | information on the effect of drugs, alcohol, and environmental |
|---|
| 23 | 23 | | hazards, including lead; and |
|---|
| 24 | 24 | | (2) a description of the growth and development of an |
|---|
| 25 | 25 | | unborn child that occur during each trimester of pregnancy. |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2017. |
