55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to discrimination by a health care provider based on
88 immunization status.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0333 to read as follows:
1212 Sec. 531.0333. DISCRIMINATION BY HEALTH CARE PROVIDER BASED
1313 ON IMMUNIZATION STATUS. (a) A health care provider may not refuse
1414 to provide health care services to a patient solely because a
1515 patient has or has not received immunization for a particular
1616 communicable disease.
1717 (b) A health care provider that violates this section is not
1818 eligible to receive money from the state for services provided to
1919 patients, including under the medical assistance program under
2020 Chapter 32, Human Resources Code, or under the state child health
2121 plan under Chapter 62, Health and Safety Code.
2222 SECTION 2. If before implementing any provision of this Act
2323 a state agency determines that a waiver or authorization from a
2424 federal agency is necessary for implementation of that provision,
2525 the agency affected by the provision shall request the waiver or
2626 authorization and may delay implementing that provision until the
2727 waiver or authorization is granted.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
