12 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 7 | | SECTION 1. Section 4001.351, Insurance Code, is amended to |
---|
14 | 8 | | read as follows: |
---|
15 | 9 | | Sec. 4001.351. APPLICABILITY. This subchapter applies |
---|
16 | 10 | | only to an applicant for a license as an agent under: |
---|
17 | 11 | | (1) Subchapters B and E, Chapter 4051; and |
---|
18 | 12 | | (2) Subchapters B, D, [and] E, and G, Chapter 4054. |
---|
19 | 13 | | SECTION 2. Section 4001.353(a), Insurance Code, is amended |
---|
20 | 14 | | to read as follows: |
---|
21 | 15 | | (a) The department may issue a provisional permit under this |
---|
22 | 16 | | subchapter on receipt of: |
---|
23 | 17 | | (1) a written application for a provisional permit; |
---|
24 | 18 | | (2) a properly completed license application, |
---|
25 | 19 | | nonrefundable fee, and each other item required for a license under |
---|
26 | 20 | | this chapter and Subchapter B or E, Chapter 4051, or Subchapter B, |
---|
27 | 21 | | D, [or] E, or G, Chapter 4054, as applicable; |
---|
28 | 22 | | (3) the nonrefundable fee in an amount authorized by |
---|
29 | 23 | | Subsection (c); and |
---|
30 | 24 | | (4) a certificate signed by the appointing agent, |
---|
31 | 25 | | insurer, or health maintenance organization stating that: |
---|
32 | 26 | | (A) the applicant completed the training, if any, |
---|
33 | 27 | | and passed the examination required for the issuance of the license |
---|
34 | 28 | | for which the application is submitted; |
---|
35 | 29 | | (B) the appointing agent, insurer, or health |
---|
36 | 30 | | maintenance organization completed a background check on the |
---|
37 | 31 | | applicant that shows that the applicant has not been convicted of: |
---|
38 | 32 | | (i) a felony; or |
---|
39 | 33 | | (ii) an act that requires the applicant to |
---|
40 | 34 | | receive written consent under 18 U.S.C. Section 1033 to engage in |
---|
41 | 35 | | the business of insurance; |
---|
42 | 36 | | (C) the applicant has not responded |
---|
43 | 37 | | affirmatively to any question on the license application that |
---|
44 | 38 | | indicates the applicant has a criminal conviction or has been |
---|
45 | 39 | | involved in an administrative action that may disqualify the |
---|
46 | 40 | | applicant from receiving a license; and |
---|
47 | 41 | | (D) the appointing agent, insurer, or health |
---|
48 | 42 | | maintenance organization will supervise the work of the applicant. |
---|
49 | 43 | | SECTION 3. This Act takes effect September 1, 2017. |
