104 AN ACT
115 relating to provisional permits for certain insurance agents.
126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Section 4001.351, Insurance Code, is amended to
148 read as follows:
159 Sec. 4001.351. APPLICABILITY. This subchapter applies
1610 only to an applicant for a license as an agent under:
1711 (1) Subchapters B and E, Chapter 4051; and
1812 (2) Subchapters B, D, [and] E, and G, Chapter 4054.
1913 SECTION 2. Section 4001.353(a), Insurance Code, is amended
2014 to read as follows:
2115 (a) The department may issue a provisional permit under this
2216 subchapter on receipt of:
2317 (1) a written application for a provisional permit;
2418 (2) a properly completed license application,
2519 nonrefundable fee, and each other item required for a license under
2620 this chapter and Subchapter B or E, Chapter 4051, or Subchapter B,
2721 D, [or] E, or G, Chapter 4054, as applicable;
2822 (3) the nonrefundable fee in an amount authorized by
2923 Subsection (c); and
3024 (4) a certificate signed by the appointing agent,
3125 insurer, or health maintenance organization stating that:
3226 (A) the applicant completed the training, if any,
3327 and passed the examination required for the issuance of the license
3428 for which the application is submitted;
3529 (B) the appointing agent, insurer, or health
3630 maintenance organization completed a background check on the
3731 applicant that shows that the applicant has not been convicted of:
3832 (i) a felony; or
3933 (ii) an act that requires the applicant to
4034 receive written consent under 18 U.S.C. Section 1033 to engage in
4135 the business of insurance;
4236 (C) the applicant has not responded
4337 affirmatively to any question on the license application that
4438 indicates the applicant has a criminal conviction or has been
4539 involved in an administrative action that may disqualify the
4640 applicant from receiving a license; and
4741 (D) the appointing agent, insurer, or health
4842 maintenance organization will supervise the work of the applicant.
4943 SECTION 3. This Act takes effect September 1, 2017.
