66 AN ACT
77 relating to certain prohibitions on contributions and expenditures
88 from political funds by a lobbyist; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 253, Election Code, is
1111 amended by adding Section 253.006 to read as follows:
1212 Sec. 253.006. CERTAIN CONTRIBUTIONS AND EXPENDITURES BY
1313 LOBBYISTS PROHIBITED. (a) Notwithstanding any other provision of
1414 law, a person required to register under Chapter 305, Government
1515 Code, may not knowingly make or authorize a political contribution
1616 or political expenditure from political contributions accepted by
1717 the person as a candidate or officeholder.
1818 (b) A person who violates this section commits an offense.
1919 An offense under this section is a Class A misdemeanor.
2020 SECTION 2. Subchapter B, Chapter 305, Government Code, is
2121 amended by adding Section 305.029 to read as follows:
2222 Sec. 305.029. EXPENDITURES FROM POLITICAL CONTRIBUTIONS
2323 PROHIBITED. (a) In this section, "political contribution" has the
2424 meaning assigned by Section 251.001, Election Code.
2525 (b) Notwithstanding any other provision of law, a person
2626 required to register under this chapter may not knowingly make or
2727 authorize an expenditure under this chapter from political
2828 contributions accepted by the person as a candidate or
2929 officeholder.
3030 SECTION 3. Section 253.006, Election Code, as added by this
3131 Act, and Section 305.029, Government Code, as added by this Act,
3232 apply to a political contribution, political expenditure, or
3333 lobbying expenditure made on or after January 6, 2019, from funds
3434 accepted as a political contribution, regardless of the date the
3535 funds were accepted.
3636 SECTION 4. This Act takes effect September 1, 2017.
